Bill gives courts authority to address violators of Leandra’s Law

Senator Steve Saland (R, I, C - Poughkeepsie) today announced that the Senate has passed his legislation that authorizes courts to re-impose a sentence of probation and a requirement of an ignition interlock device (IID) following revocation of a sentence of probation or conditional discharge imposed under the Child Passenger Protection Act (Leandra’s Law) (S.6680).

This bill clarifies the intent of Leandra’s Law to ensure that the courts have the ability to re-sentence a defendant who violates probation or conditional discharge and impose an obligation to re-install an IID on their vehicle.

“This legislation is designed to allow the court to impose a sentence that best ensures that a defendant does not continue to drink and drive,” stated Senator Saland. “Violators should not be able to circumvent the law.”

S.6680 is one in a series of measures being introduced at the request of the Chief Administrative Judge upon the recommendation of her Advisory Committee on Criminal Law and Procedure.

The bill has been sent to the Assembly for consideration.
