Kaplan Bill Closing Loophole in Gun License Background Check Process Signed Into Law By Gov. Andrew M. Cuomo

CARLE PLACE, NY (September 3, 2019) – Today, Governor Andrew M. Cuomo signed legislation sponsored by Senator Anna M. Kaplan (S.2438), which closes a dangerous loophole in New York's firearm license background check process that allowed part-time state residents to avoid a thorough review of mental health records in consideration of a gun license.

“Our nation is plagued by an epidemic of gun violence that demands our full attention and action, and I’m proud that New York continues to lead the way as a beacon of progress for other states,” said Senator Anna M. Kaplan. “This bill closes a dangerous loophole in our gun license background check process, ensuring that part-time New York residents buying a gun receive the same thorough review as full-time residents. I thank Governor Cuomo for making New York a leader for common-sense gun safety reforms, and I applaud him for signing this measure into law.”

The bill, S.2438 introduced by Senator Anna M. Kaplan, will require part-time state residents applying for gun permits to allow New York permitting authorities to review out-of-state mental health records. Currently, gun license applicants who live in NY part-time and/or receive mental health treatment out-of-state are treated differently than full-time NY residents, allowing them to avoid the comprehensive review mandated by law.

Senator Kaplan concluded, "we don't need any more empty gestures, what we need are more tools to keep weapons out of the hands of those who shouldn't have them, and by closing this loophole, we will ensure that all those applying for a firearm license in New York are subject to the same rigorous background check process."
