The following bills were approved in the NYS Senate. Senator Gallivan's vote is noted.
S131A Clarifies the status of certain persons exempt from optometrist license requirements to allow an optometry student who attends a school outside of New York State that has accreditation acceptable to the State Education Department to engage in supervised clinical work. A PRINT - applies only to "actively enrolled" and "currently registered." AYE
S156 Relates to designating the month of May as "Maternal Mental Health Awareness Month". AYE
S2084 Prohibits forensic child custody evaluators who have been terminated for cause from appearing as an expert witness in family court custody and visitation proceedings. AYE
S985 Codifies the title of “Medicaid Director” within the statute and requires such position to be appointed by the Governor and approved by the Senate, similar to the appointment of the Commissioner of the Department of Health. AYE
S3348 This bill amends the public health law to require that the office of addiction services and supports, in consultation with the department of health, shall develop or utilize existing education materials to be provided to general hospitals to disseminate to individuals with a documented substance use disorder or who appear to have or be at risk for a substance use disorder during discharge planning. AYE
S622 The bill would amend §383 of Executive Law to require that the building and fire regulations generally applicable in any locality within the State shall also apply to all building and structures owned by or in which space is leased by state agencies and authorities. AYE
S5706 The bill would amend Þ 1308 of Real Property Actions and Proceedings Law (RPAPL) to increase the maximum civil penalty from $500 to $1,000 per day per property for each day the mortgagee or agent of the mortgagee has been in violation. NAY
S5881 Removes certain requirements for prospective purchasers of manufactured home parks; provides that owners of manufactured homes, a manufactured homeowner's association, or any other impacted party may bring an action for injunctive relief, actual damages, and attorneys' fees and costs for any violation of this section; makes related provisions. AYE
S4936 Provides that all equipment used for the transmission and switching of radio signals for the provision of commercial mobile radio service or mobile internet access service no longer constitutes real property subject to the real property tax law. AYE
S5896 Exempts certain commercial lines insurance transactions placed by wholesale insurance brokers from the excess line diligent effort requirement. NOTE - Under current law, brokers must make a good faith attempt to seek coverage from a licensed insurer before turning to the excess line market. This is called a diligent effort. A diligent effort to be complete when three licensed insurers have considered and then rejected a risk. AYE
