7 Madam President. I'm pleased we're passing this
8 bill today.
9 In the category of bills that are
10 outdated, unnecessary and potentially dangerous,
11 our citizen's arrest law is at the top of the
12 list. The idea that we would empower average
13 New Yorkers to go out there and enforce the laws
14 on their own, with potentially deadly force, we
15 don't need to think too hard to imagine why that
16 would create all sorts of problems.
17 And unfortunately, we don't need to
18 look too far to see it in action. Just fairly
19 recently in history, in the State of Georgia,
20 Ahmaud Arbery was a young Black man who was just
21 jogging through his neighborhood and was
22 confronted by people who thought they were making
23 a citizen's arrest of someone they believed had
24 committed a crime.
25 The bias that occurs in those

1 situations is fairly obvious for all to see. It
2 is a provision that has been used with racist
3 consequences. And unfortunately, Ahmaud Arbery
4 was killed in that exchange.
5 I also want to credit Representative
6 Carl Gilliard of Georgia, and I've been working
7 with him on an effort to do this throughout the
8 country. Georgia did in fact just make
9 significant changes and repeals to their
10 citizen's arrest law, and I'm pleased that we are
11 taking the same step here in New York today.
12 This will increase the safety of
13 New Yorkers, and I appreciate my colleagues'
14 support.

24 As chair of the Aging Committee, I
25 am thrilled that we are advancing a whole package

1 of bills to help seniors -- older New Yorkers.
2 And when you chair a committee like this and you
3 see so many of your colleagues step forward and
4 produce really good legislation, and then the
5 staff works to get it over the finish line and
6 the leadership steps forward to really make sure
7 that this happens, it makes our jobs really
8 satisfying.
9 So we have a whole package of bills
10 today that will help to reduce prescription drug
11 prices for seniors, will help to create more
12 affordable housing and help with utility bills
13 for older New Yorkers. It will also help prevent
14 elder abuse, which is an increasing widespread
15 problem.
16 And for those seniors who are
17 staying active longer -- and there are many, many
18 older New Yorkers these days who want to continue
19 working and be active in multiple ways -- we are
20 providing pathways to employment, pathways to
21 entrepreneurship, and literally pathways to
22 recreation. So this package of bills I think
23 does a lot for our seniors.
24 I wanted, while I'm standing here,
25 just to mention one person in particular who's on

1 my mind today because of this. Chuckie Holstein
2 is a 95-year-old powerhouse in Syracuse who
3 20 years ago started something called the
4 Citizens' Academy. And I was one of the first
5 graduates. It was an effort to train citizens to
6 understand how their local government works, who
7 the decisionmakers were in business and
8 nonprofits. And a lot of us have gone on to
9 elective office since.
10 Chuckie Holstein announced her
11 retirement yesterday at age 95. And I am just
12 deeply grateful to her for all the work she has
13 done, and I want to see many more older
14 New Yorkers follow in her path and be able to
15 stay active as long as she has.
16 So thank you, Madam President. I

1 Madam President, to explain my vote.
2 I think we all realize at this point
3 that the past year has been unbelievably
4 difficult and challenging and a terrible year.
5 We've lost loved ones, friends, family. Serious
6 illnesses. Kids couldn't get into school.
7 Businesses and jobs shut down.
8 But New Yorkers fought through it
9 and got us to this point. And this bill relates
10 to the fact that we're at a pretty good point
11 here. I think we're on our way to vanquishing
12 this virus. But we're not out of the woods yet.
13 But ironically, the clearest
14 indication that we're heading towards out of the
15 woods is that you're going to see a lot of people
16 wanting to get into the woods. Because our parks
17 are opening up, our campgrounds are opening up,
18 our beautiful forestlands in the 49th Senatorial
19 District and across this state are opening up.
20 Our lakes, our waterways. You're going to see
21 New Yorkers come out and get out there. They'll
22 be hiking, they'll be boating, they'll be
23 hunting, they'll be picnicking, they'll be
24 swimming, they'll be doing all the wonderful
25 things we love to do when everything is back to

1 normal.
2 And the fact of the matter is it's
3 not only the virus we have to protect everybody
4 against right now. That with all the wonderful
5 things they'll be doing, there's a group of
6 individuals who are challenged in certain ways.
7 They have allergies.
8 Now, they're going to be out in
9 these beautiful areas, and for the most part
10 they're going to be having a great time. But
11 those bees, those spiders will be stinging, will
12 be biting. And there will be some mistakes made
13 with the food, because a lot have food allergies.
14 And tremendously bad things can happen when they
15 go into shock.
16 So we have a law in New York State
17 which is a very important and good law for
18 safety, and we have a number of individuals who
19 can carry what's called EpiPens. Injections,
20 injectors. We have law enforcement, we have
21 firefighters, we have paramedics, we have EMTs,
22 nurses, there's a long list. Unfortunately, for
23 these wonderful areas we have in New York State
24 for tourists, for New Yorkers, these recreational
25 areas, forest rangers, EnCon police, park

1 rangers, believe it or not, they're not on the
2 list.
3 In my district, it's important for
4 them to be on that list, to have the opportunity
5 to carry those EpiPens to save people's lives.
6 And this bill is going to save people's lives.
7 It's going to allow them to carry EpiPens and, in
8 an emergency, when these allergic reactions
9 happen, it's who can get there the quickest to
10 save their lives to pull them out of this shock.
11 And when you're talking about a
12 sheriff or a chief of police or law enforcement
13 who may be 50, 60 miles away, or a park ranger
14 who is right there with a hunter, a hiker or a
15 picnicker who has this allergic reaction, it's so
16 important for them to be able to be there to save
17 those lives.
18 Now, there's a lot of people to
19 thank for this, but first and more importantly I
20 want to thank the guy who wants me to call him
21 RJ, Senator Robert Jackson over there. I want to
22 make it clear that this bill probably never comes
23 to the floor unless that Senator sponsors it,
24 supports it, reaches out to his colleagues and
25 probably my colleagues and even in the Assembly

2 And he's got a personal experience
3 he's going to talk to you about which is
4 extremely important. He's got a young daughter,
5 a pediatrician, Dr. Jackson-Owens, who's got a

9 has he endorsed this bill, but his daughter has
10 endorsed this bill. And that means a lot to me
11 also. So thank you, Senator.
12 I want to thank Senator, Leader
13 Stewart-Cousins for allowing this bill to the

15 I want to thank my leader in the
16 New York State Senate Minority, Senator Robert
17 Ortt, who's doing a tremendous job, who directs
18 our staff and all our helpers that work on our
19 bills, that fight to get our bills through
20 committees, that make our bills better. We have
21 a tremendous staff. And I want to thank the
22 Majority staff also, what they've done.
23 I in particular, after I thank the
24 staff and Leader Ortt, want to thank Kristin
25 Frank, our counsel to the Minority Leader, for

2 of course I want to thank my staff -- my staff

12 lead towards the commemoration on Memorial Day of

14 be the greatest nation in the world and have
15 protected our freedom and liberty and given their
16 last measure of effort to do that for us, and
17 hope all those individuals commemorate, remember
18 them, thank them, but also enjoy this weekend
19 with their family as we work towards not only
20 getting into the woods, but getting out of the
21 woods with this virus that's before us.

3 Madam President.
4 My colleagues, I rise to support
5 this bill, Senate Bill 4375, by my colleague
6 Senator Tedisco.
7 And in fact, let me tell you how I
8 learned about this bill. We were in another
9 hearing in which he raised the issue that he has
10 a bill about EpiPens out in our communities,
11 especially the forests and all throughout
12 New York State. And I did not know that.
13 Because as you know, Madam President, there are
14 thousands of bills within the New York State
15 Senate.
16 And I committed to him that I would
17 sign on to this bill, because I know it impacts
18 not only two members of my family, my grandson,
19 one of my grandchildren, and for another one, my
20 nephew, who are allergic to things and have used
21 EpiPens and gone to the emergency room because,
22 you know, their breathing basically started to
23 close up.
24 And so I went and communicated with
25 the leader. And obviously knowing that the

1 Assembly has passed this, I thank the leader, our
2 leader, Andrea Stewart-Cousins, and the staff
3 involved, and my staff and everybody else for
4 bringing this together in order so that park
5 rangers, forest rangers and environmental
6 conservation police officers will have the
7 opportunity to possess and administer EpiPens
8 when needed in order to save people, and some of
9 them as far as from going to the hospital, being
10 hospitalized, or even saving their life.
11 So I rise to say that relating to
12 helping lives by enabling, as I said, forest
13 rangers and police officers in order to do
14 that -- but as the proud father of a doctor, for
15 me it was an easy decision to become a cosponsor
16 of this bill. As summer fast approaches,
17 millions of New Yorkers will head outdoors, as my
18 colleague indicated, to state parks and beaches
19 and other places like that.
20 And I've said publicly that when I
21 go out with my grandson, I carry his backpack and
22 in that backpack is an EpiPen. Because one thing
23 I know is you never know. You know, even though
24 he may not be eating food, but he may run into
25 something and put his hands on something and then

1 put his fingers in his mouth, and all of a sudden
2 he's having a reaction.
3 Let me just read to you what my
4 daughter said -- my daughter Dr. Saadiya
5 Jackson-Owens, who is a pediatrician and the mom
6 of my grandson, who suffers from food allergies:
7 "This bill that my dad, Robert Jackson, is
8 supporting to allow park rangers, forest rangers
9 and environmental police officers to carry and
10 administer epi auto-injectors, aka EpiPens, is a
11 no-brainer. Giving an epi shot reduces
12 hospitalization, morbidity and mortality, and
13 more importantly is time-sensitive. Having epi
14 auto-injectors in the field will add to the
15 safety and security that the park and forest
16 rangers and environmental police officers
17 provide."
18 Therefore, my daughter and I support
19 this bill, and I invite all my colleagues to join
20 in, in voting aye.
