11                 GRANTHI DILSHER SINGH:   Waheguruwe.

13    Waheguru ji ka Khalsa waheguru ji ki fateh ji.  

14                 O Almighty Waheguru, the Eternal 

15    Truth, we stand before You today in remembrance 

16    of the countless sacrifices made by the Sikhs in 

17    their pursuit of justice, truth, and equality.  

18                 For over six centuries, the Khalsa 

19    has upheld the divine rule of Guru Nanak 

20    Patshah -- Halemi Raj -- a vision of 

21    Benevolent Rule where all humanity is one, 

22    free from tyranny and oppression and human 

23    suffering are addressed.  

24                 O Waheguru, we remember the 

25    atrocities committed against the Sikh faith, from

 1    the oppressive rule of the Mughals to the 

 2    betrayal by the British, and the injustices of 

 3    independent India.  Despite Sikhs shedding blood 

 4    for freedom, our people were branded as 

 5    criminals, our history distorted, and our Guru's 

 6    sacred throne desecrated in 1984.  Thousands of 

 7    innocent Sikhs were massacred, their homes 

 8    burned, property looted, daughters dishonored -- 

 9    but the Khalsa did not bow.  

10                 O Akaal Purakh, bless us with the 

11    indomitable spirit of our countless ancestors who 

12    embraced martyrdom for truth -- Guru Arjan 

13    Patshah's serenity, Guru Tegh Bahadur Patshah's 

14    supreme sacrifice, and General Banda Singh 

15    Bahadar's fearless courage.  

16                 May we always stand against tyranny, 

17    not for revenge, but for righteousness.  May our 

18    voices rise against injustice, not for division, 

19    but for unity.  

20                 O Protector of the meek, grant us 

21    the strength to uphold to build Begampura -- a 

22    world without sorrow where no one lives in fear, 

23    no downfall, no extra taxes, where truth prevails 

24    over falsehood and universal brotherhood, 

25    equality, love, peace and justice reign supreme.

 1                 May the Khalsa remain forever free, 

 2    fearless, and devoted to the divine Hukam (the 

 3    Lord Command) and work for coexistence and the 

 4    well-being of all.  

 5                 Guru Nanak Patshah in his hymns

 7    with Me {in Punjabi}, be fearless and be ready 

 8    for sacrifice {in Punjabi}; if choose this path

16    Senator Ramos, recognizing the contributions of 

17    the Sikh community and commemorating the 

18    Sikh massacre of 1984.

21                 SENATOR RAMOS:   Thank you, 

22    Mr. President.  

23                 I proudly rise today representing my 

24    neighbors, who are here today for a historic Sikh 

25    Day of Action organized by the New York City Sikh

 1    Council, hosting over a hundred Sikh brothers and 

 2    sisters, many of whom are present in today's 

 3    gallery.

 4                 With today's resolution, the 

 5    New York State Senate is making history.  We 

 6    recognize the many contributions of the Sikh 

 7    community to our state and nation, acknowledging 

 8    the painful history that has shaped their 

 9    resilience and strength.

10                 In 1984, after the assassination of 

11    Indian Prime Minister Indira Gandhi, 

12    state-sanctioned violence was unleashed upon the 

13    Sikh community in India.  Over the next several 

14    days, tens of thousands of Sikhs were brutally 

15    murdered, women were assaulted and raped, men 

16    were burned alive, families were torn apart, and 

17    entire neighborhoods were set on fire.  Sikh 

18    homes, businesses and Gurdwaras, their sacred 

19    places of worship, were also destroyed.

20                 It was not a random act of violence.  

21    And while the federal government doesn't yet 

22    recognize it as such, it was a genocide.  It was 

23    organized, it was deliberate, and it was carried 

24    out with the complicity of government officials:  

25    A coordinated effort to silence, oppress and

 1    terrorize the Sikh people.

 2                 And nearly 40 years later, survivors 

 3    and human rights activists and organizations are 

 4    still fighting for justice.  Today Sikhs still 

 5    face persecution, not only in India but across 

 6    the world, including right here in the 

 7    United States, where even after 9/11 the 

 8    surveillance of the Muslim community was used as 

 9    an excuse to scapegoat the Sikh community.  This 

10    persecution continues through the ongoing scourge 

11    of transnational repression.  

12                 To the survivors who are here with 

13    us today, and the families who have lived through 

14    this unimaginable pain, we want you to know that 

15    you are seen and heard and that we stand with 

16    you.  Your fight for justice is our fight as 

17    well.  Here in New York we stand for justice and 

18    against religious persecution, and with the Sikh 

19    community in their pursuit of truth.  

20                 Today is not just about remembrance, 

21    it's about action.  It's about ensuring that 

22    voices are heard, that stories of survivors are 

23    told, and that no government anywhere in the 

24    world is allowed to commit such atrocities 

25    without consequences.

 1                 Passing this resolution is a strong 

 2    statement.  It says that New York is a state 

 3    built on diversity, inclusion and justice, stands 

 4    with the victims of the 1984 genocide, and it 

 5    says that New York recognizes the pain and the 

 6    suffering of the Sikh community.  And it says 

 7    that we will not allow history to be rewritten or 

 8    erased.

 9                 You are not alone, and your fight 

10    for justice is our fight too.

11                 Thank you.

12                 ACTING PRESIDENT BAILEY:   Thank 

13    you, Senator Ramos.

15                 SENATOR LIU:   Thank you, 

16    Mr. President.  

17                 Waheguru Ji Ka Khalsa, Waheguru Ji 

18    Ki Fateh!  

19                 I want to thank Senator Ramos for 

20    offering this important resolution, which I 

21    wholeheartedly support.  I support what she said; 

22    I'm not going to repeat everything.  

23                 But the Sikh community, 

24    Mr. President, has been persecuted in many ways 

25    around the world and right here, unfortunately,

 1    in our own state.  Which is why we have to 

 2    recognize -- why we have to pass this important 

 3    resolution.  

 4                 We all remember not too long ago the 

 5    Sikh community was unfairly targeted and 

 6    extremely scapegoated for the attacks of 

 7    September 11th.  And since then there have been 

 8    many instances of discrimination, on-the-job 

 9    discrimination as well as a massacre in a 

10    Sikh temple, a Sikh Gudwara, not too long ago.  

11                 So we have to remember this 

12    community for what they've gone through, but also 

13    remember them for the extreme contributions, the 

14    positive contributions in business, in education, 

15    in media, in the corporate world, and in the 

16    professions.  And we would not be New York State 

17    without the incredible contributions of the 

18    Sikh community.  

19                 And indeed, a few years ago we did 

20    pass legislation that was signed into law that 

21    prohibits discrimination in public or private 

22    places of work against people because of what 

23    they wear or their garb, especially when it's 

24    required for their religious faith.

25                 So, Mr. President, I urge all of our

 1    colleagues to support this resolution.

 6                 SENATOR SANDERS:   Thank you, 

 7    Mr. President.

 8                 My colleagues have spoken well about 

 9    the Sikh community.  I will just add that one of 

10    the things that I have found most amazing about 

11    the Sikh community is the -- is something that 

12    they may consider very simple, but for the 

13    colleagues who don't know, they have a meal that 

14    they serve to the public.  And anyone who is 

15    hungry, of any faith, can walk in and sit down 

16    and get something to eat, the same thing that 

17    everyone else is eating.  

18                 And I think that this is just 

19    something amazing.  I think it's something that 

20    perhaps every religious group should do.  And 

21    it's done every day.  And I have always found 

22    that interesting.  

23                 And I've been blessed to have had 

24    many members of the Sikh community.  For most of 

25    my term I've covered the Richmond Hill,

 1    South Ozone, Ozone Park community, so I've had 

 2    the pleasure of being with the Sikh community and 

 3    learning from them.

 4                 So of course having learned from 

 5    them in so many different ways, I am very 

 6    grateful to be here and to support this 

 7    resolution.  I thank the sponsor, and I thank 

 8    this body for being bold enough.  

 9                 And I encourage all of us, on 

10    another day, treat yourself right and go to one 

11    of their temples and sit down and have some food 

12    and some good conversation.  And imagine what 

13    America could be if all of us went out of our way 

14    to some other -- out of our comfort zone and sat 

15    down and learned from other people.

16                 I gladly vote yes, Mr. President.

 1                 SENATOR BORRELLO:   Thank you, 

 2    Mr. President.  

 3                 I have a lot of concerns with this 

 4    bill.  First and foremost, it's going to 

 5    automatically renew Medicaid applications.  The 

 6    problem in New York State we don't know how many 

 7    people are actually eligible.  

 8                 Right now there's a report out that 

 9    says roughly 3 million people are eligible for 

10    Medicaid that are actually collecting, right now, 

11    courtesy of New York State taxpayer, to the tune 

12    of $20 billion a year, a million of which we 

13    can't even prove actually exist.  There's a lot 

14    of fraud in this system.  

15                 What's more disturbing is 44 percent 

16    of New Yorkers and 60 percent of people in 

17    New York City are on Medicaid.  We have to ask 

18    ourselves, is this the right path?  

19                 Everyone who deserves help should 

20    get help.  But the fact that we have more than a 

21    million people that the Department of Health has 

22    refused to identify as being qualified is 

23    incredibly disturbing.  And automatically 

24    renewing people for this I think is going to be 

25    an even bigger mistake.

 1                 So I'll be voting no.  Thank you.

20                 SENATOR HELMING:   Thank you, 

21    Mr. President.  

22                 I rise to explain my vote on the 

23    bill before us that, according to the sponsor's 

24    bill, bans no-rehire clauses.  This bill and the 

25    timing and bringing it to this floor are highly,

 1    highly hypocritical, in light of the Governor's 

 2    extreme no-rehire ban for 2,000 corrections 

 3    officers.

 4                 These men and women stood up for a 

 5    safer environment within our state-owned and 

 6    operated correctional facilities, and they have 

 7    been banned from being rehired by the state.  

 8                 And if that's not extreme enough, 

 9    the Governor used her authority to override 

10    municipal home rule and county law to further 

11    harm our corrections officers and their families 

12    by banning the hiring at the local level.

13                 Earlier I heard that it's all about 

14    action on this floor, it's all about justice.  

15    Well, you know what?  Our corrections officers 

16    deserve some justice.  This overreach and this 

17    attack on former state employees should concern 

18    everyone in this chamber and elected officials at 

19    every level of government.

20                 Mr. President, we should not be 

21    picking winners and losers when it comes to 

22    no-rehire bans.

23                 For this reason, I'll be voting no 

24    and I urge everyone in this body to do the same.

25                 ACTING PRESIDENT BAILEY:   Senator

 1    Helming to be recorded in the negative.

 2                 Senator Borrello to explain his 

 3    vote.

 4                 SENATOR BORRELLO:   Thank you, 

 5    Mr. President.  

 6                 Senator Helming summarized it quite 

 7    brilliantly.  And what we're saying here is that 

 8    if an agreement has come together between an 

 9    employee and an employer and actually a 

10    compensation has been offered, that we're not 

11    going to enforce the ability for an employer to 

12    say, You cannot be hired by anyone else.

13                 But yet we have Governor Hochul 

14    doing exactly that.  Two thousand families that 

15    aren't going to be able to earn a living anymore 

16    because she felt she was somehow disrespected.  

17    Even though they were living in dangerous 

18    conditions, working in dangerous conditions in 

19    our prisons.  Which is the reason why they went 

20    on strike.  

21                 Even though the reality is they were 

22    likely not in violation of the Taylor Act because 

23    of the fact that they were actually in fear for 

24    their lives working in these prisons, yet she is 

25    going to blackball them.  As Senator Helming

 1    said, not just at state jobs -- county jobs, 

 2    local jobs.  You want to be an officer at a 

 3    school?  No, you can't do that.  But yet this 

 4    legislation allows it.  For a private industry 

 5    who's already come to an agreement, made a 

 6    remuneration offer, they can't do it.  

 7                 So again, completely hypocritical 

 8    and unfair, and I'll be voting no.

12                 Senator Gounardes to explain his 

13    vote.

14                 SENATOR GOUNARDES:   Thank you, 

15    Mr. President.  

16                 I appreciate my colleagues for 

17    confusing two different issues that we're talking 

18    about at issue here in this bill.  

19                 This bill is about victims of the 

20    workplace and sexual harassment being told, as a 

21    condition of their settlement when they have 

22    experienced heinous and egregious behavior by 

23    their supervisors or their coworkers, that they 

24    don't have to accept the inability of themselves 

25    to pursue another job opportunity anywhere in

 1    their company around the entire globe.  

 2                 We're not talking about corrections 

 3    officers, we're not talking about the illegal 

 4    strike that took place last month.  We're talking 

 5    about people being told, You want to stop being

 9                 Imagine you're a Chase teller at a 

10    bank working for Chase, and you have a sexual 

11    harassment claim, and the only way you can 

12    vindicate your own rights is to say I will never 

13    work at a Chase bank anywhere on the globe.  

14                 I'm just using that as an example; 

15    I'm not singling out Chase.  

16                 But that is the point here.  That's 

17    all this bill is about.  

18                 This is a body that is supposed to 

19    stand up for the victims of sexual harassment and 

20    workplace discrimination, and that's entirely 

21    what this bill is meant to do.  This is the fifth 

22    time that this chamber is passing this bill, 

23    because we believe on this side that we're not 

24    going to let victims be subject to the coercive 

25    power of their supervisors.
