  printed to be committed to the Committee on Rules

AN ACT to amend the election law, in relation to absentee voting

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  Section  8-400 of the election law is amended by adding a
new subdivision 10 to read as follows:
  10. NOTWITHSTANDING ANY OTHER PROVISION OF LAW, A QUALIFIED  VOTER  IN
ANY VILLAGE, TOWN OR CITY MAY VOTE IN ANY SPECIAL ELECTION OR ON A LOCAL
REFERENDUM  OR ANY QUALIFIED VOTER OF A SCHOOL OR FIRE DISTRICT MAY VOTE
IN ANY DISTRICT ELECTION OR ON A LOCAL  REFERENDUM  BY  ABSENTEE  BALLOT
PURSUANT  TO  THE  PROVISIONS  OF  THIS  SECTION. THE LIST OF REGISTERED
VOTERS IF SO REQUESTED BY THE VILLAGE, TOWN, CITY,  SCHOOL  DISTRICT  OR
FIRE  DISTRICT  SHALL  BE FURNISHED BY THE RESPECTIVE BOARD OF ELECTIONS
AND NEED NOT BE COMPILED BY THE AFORESAID VOTING UNIT.
  S 2. This act shall take effect on the first of January next  succeed-
ing the date on which it shall have become a law.
