  ment Operations

AN  ACT  to amend the executive law, in relation to the use of biodiesel
  fuel in state vehicles

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1. The executive law is amended by adding a new section 201-b
to read as follows:
  S 201-B. USE OF BIODIESEL IN STATE VEHICLES. 1.  ANY  DIESEL  OPERATED
VEHICLES  WITHIN  THE  STATE  FLEET  SHALL BE REPLACED OR RETROFITTED TO
OPERATE ON A BIODIESEL BLEND AT THE FOLLOWING LEVELS:
  A.  FOR  JANUARY  FIRST,  TWO   THOUSAND   ELEVEN   THROUGH   DECEMBER
THIRTY-FIRST, TWO THOUSAND ELEVEN, FIVE PERCENT BIODIESEL BLEND;
  B.   FOR   JANUARY   FIRST,   TWO  THOUSAND  TWELVE  THROUGH  DECEMBER
THIRTY-FIRST, TWO THOUSAND TWELVE, TEN PERCENT BIODIESEL BLEND;
  C. FOR JANUARY FIRST, TWO THOUSAND  THIRTEEN  AND  THEREAFTER,  TWENTY
PERCENT BIODIESEL BLEND.
  2.  FOR PURPOSES OF THIS SECTION, "BIODIESEL BLEND" SHALL MEAN RENEWA-
BLE, BIODEGRADABLE, MONO ALKYL ESTER  COMBUSTIBLE  LIQUID  FUEL  DERIVED
FROM AGRICULTURAL PLANT OILS, ANIMAL FATS OR WASTE OILS AND GREASES.
  S 2. This act shall take effect immediately.
