BILL NUMBER: S3096 SPONSOR: ORTT TITLE OF BILL: An act to amend the executive law, in relation to the use of biodiesel and renewable diesel fuel in state vehicles PURPOSE: To mandate the state to use biodiesel in all state vehicles that are operated on diesel. SUMMARY OF SPECIFIC PROVISIONS: Section 1 - Establishes the legislative intent of the bill. 201-b: Establishes any vehicle within the state fleet shall be replaced or retrofitted to operate a biodiesel blend at the following levels: a: For January 1, 2025, a five percent blend b: For January 1, 2026 a ten percent blend c: For January 1, 2027 a twenty percent blend 2. Explains for the purpose of this legislation the use of "biodiesel"

ORTT -- read twice and ordered printed, and when printed to be committed to the Committee on Investigations and Govern- ment Operations AN ACT to amend the executive law, in relation to the use of biodiesel and renewable diesel fuel in state vehicles THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The executive law is amended by adding a new section 201-b to read as follows: § 201-B. USE OF BIODIESEL AND RENEWABLE DIESEL IN STATE VEHICLES. 1. ANY DIESEL OPERATED VEHICLES WITHIN THE STATE FLEET SHALL BE REPLACED OR RETROFITTED, IF NECESSARY, TO OPERATE ON BIODIESEL OR RENEWABLE DIESEL AT THE FOLLOWING LEVELS: A. FOR JANUARY FIRST, TWO THOUSAND TWENTY-SIX THROUGH DECEMBER THIR- TY-FIRST, TWO THOUSAND TWENTY-SIX, FIVE PERCENT BIODIESEL OR RENEWABLE DIESEL; B. FOR JANUARY FIRST, TWO THOUSAND TWENTY-SEVEN THROUGH DECEMBER THIR- TY-FIRST, TWO THOUSAND TWENTY-SEVEN, TEN PERCENT BIODIESEL OR RENEWABLE DIESEL; C. FOR JANUARY FIRST, TWO THOUSAND TWENTY-EIGHT AND THEREAFTER, TWENTY PERCENT BIODIESEL OR RENEWABLE DIESEL. 2. FOR PURPOSES OF THIS SECTION, "BIODIESEL" OR "RENEWABLE DIESEL" SHALL MEAN A FUEL THAT MEETS THE REQUIREMENTS OF THE ASTM INTERNATIONAL SPECIFICATION D6751 OR THE REQUIREMENTS OF THE ASTM INTERNATIONAL SPEC- IFICATION D975. "RENEWABLE DIESEL" SHALL NOT INCLUDE CESSED BIOMASS WITH A FEEDSTOCK THAT IS NOT BIOMASS; PROVIDED, HOWEVER, THAT "RENEWABLE DIESEL" SHALL BE PRODUCED FROM HYDROPROCESSING RENEWABLE BIOMASS FEEDS- TOCKS. "BIODIESEL" SHALL MEAN RENEWABLE, BIODEGRADABLE, MONO ALKYL ESTER COMBUSTIBLE LIQUID FUEL DERIVED FROM AGRICULTURAL PLANT OILS, ANIMAL FATS OR WASTE OILS AND GREASES. § 2.
