BILL NUMBER: S806 TITLE OF BILL : An act to amend the general business law, in relation to prices on menus PURPOSE OR GENERAL IDEA OF BILL : Provides for listing cost of items on a menu in any place where food is served, prepared, or sold to the general public. SUMMARY OF SPECIFIC PROVISIONS : This legislation.amends the general business law by adding a new §396-rrr, regarding menu pricing. This act would require the listing of prices for each and every item set forth on the menu except for the price of seasonal or special order items. Menu pricing would be required in any place where food is prepared, sold or served for and to the general public. JUSTIFICATION : There have been instances where restaurants do not list their prices for particular items (i.e. beverages). This legislation requires that all items on the menu have their price listed, avoiding any unintended or misunderstood charges. PRIOR LEGISLATIVE HISTORY :

KRUGER -- read twice and ordered printed, and when printed to be committed to the Committee on Consumer Protection AN ACT to amend the general business law, in relation to prices on menus THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The general business law is amended by adding a new section 396-rrr to read as follows: S 396-RRR. PRICES ON MENUS. A PERSON OR CORPORATION ENGAGED IN THE PREPARATION AND SALE OF FOOD IN ANY HOTEL, PUBLIC RESTAURANT, PUBLIC DINING ROOM, DINING CAR, DRUG STORE, SODA FOUNTAIN, STEAMBOAT OR IN ANY OTHER PLACE WHERE FOOD IS PREPARED, SOLD OR SERVED FOR AND TO THE GENER- AL PUBLIC IN THIS STATE SHALL LIST THE PRICE OF EACH AND EVERY ITEM SET FORTH ON THE MENU DISTRIBUTED OR EXHIBITED TO CUSTOMERS EXCEPT FOR THE PRICE OF SEASONAL OR SPECIAL ORDER ITEMS.
