BILL NUMBER: S746 TITLE OF BILL : An act to amend the social services law, in relation to expedited service in the food stamp program PURPOSE : Provides that an applicant shall receive assistance within the next business day if they are determined to be eligible for the food stamp program. SUMMARY OF PROVISIONS : Adds new subdivision 12 to Section 95 of the Social Services Law, which provides that a person who qualifies for expedited food stamps shall receive them by the next business day following application. JUSTIFICATION : Current regulations provide that a decision does not need to be made on an application for expedited food stamps for 5 days. If a family is without money for food, they can turn to a food pantry; but the maximum amount of food they will receive is 2-3 days worth. Five days is to long to wait, when with government technology a preliminary decision can be made in a day. LEGISLATIVE HISTORY :

KRUEGER, DUANE, PARKER, SCHNEIDERMAN, SERRANO -- read twice and ordered printed, and when printed to be committed to the Committee on Social Services AN ACT to amend the social services law, in relation to expedited service in the food stamp program THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 95 of the social services law is amended by adding a new subdivision 12 to read as follows: 12. WHENEVER A PERSON MAKES AN APPLICATION FOR EXPEDITED SERVICE OF THE FOOD STAMP PROGRAM PURSUANT TO SECTION 387.8 OF TITLE 18 OF THE NEW YORK STATE CODES, RULES, AND REGULATIONS, THE LOCAL DEPARTMENT OF SOCIAL SERVICES SHALL PROVIDE SUCH FOOD STAMPS TO SUCH APPLICANT WITHIN THE NEXT BUSINESS DAY IF IT IS DETERMINED THAT THE APPLICANT IS ELIGIBLE TO PARTICIPATE IN THE PROGRAM. S 2. This act shall take effect on the thirtieth day after it shall have become a law. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
