BILL NUMBER: S805 TITLE OF BILL : An act to amend the vehicle and traffic law, in relation to parking infractions PURPOSE OR GENERAL IDEA OF BILL : Makes available applications for dismissal of parking violations where information is omitted, misdescribed, or illegible on the violation notice, despite the fact that a default judgment was already entered. SUMMARY OF SPECIFIC PROVISIONS : Paragraph (b) of subdivision 2-a of section 238 of the vehicle and traffic law is amended allowing applications for dismissal of charges despite the fact that a default judgment was . already made. JUSTIFICATION : People should not be held responsible for any default judgments made when their ticket information was omitted, misdescribed, or illegible. KRUGER -- read twice and ordered printed, and when printed to be committed to the Committee on Transportation AN ACT to amend the vehicle and traffic law, in relation to parking infractions THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph (b) of subdivision 2-a of section 238 of the vehicle and traffic law, as added by chapter 224 of the laws of 1995, is amended to read as follows: (b) If any information which is required to be inserted on a notice of violation is omitted from the notice of violation, misdescribed, or illegible, the violation shall be dismissed upon application of the person charged with the violation. SUCH APPLICATION FOR DISMISSAL SHALL BE AVAILABLE TO THE PERSON CHARGED WITH THE VIOLATION DESPITE THE FACT THAT A DEFAULT JUDGMENT WAS ENTERED PURSUANT TO SECTION TWO HUNDRED FORTY-ONE OF THIS ARTICLE. S 2. This act shall take effect on the thirtieth day after it shall have become a law and shall apply to any notice of violation issued after such date.
