BILL NUMBER:S2613 TITLE OF BILL: An act to amend the vehicle and traffic law, in relation to distribution of health care proxy information PURPOSE OR GENERAL IDEA OF BILL: To promote use of health care proxies by distributing information through Department of Motor Vehicles mailings. SUMMARY OF SPECIFIC PROVISIONS: The Vehicle and Traffic Law is amended by adding a new section 397-c to require the Department of Motor Vehicles to include health care proxy forms and instructions developed by the Department of Health to residents in mailings on drivers' licenses and periodically in mailings on registrations. JUSTIFICATION: People want to and should have their health care wishes honored. Yet a large majority of New York residents do not have a health care proxy. As a result, their health care wishes are usually unknown and people are given medical treatment that they would not want or not given treatment that they would want. STAVISKY -- read twice and ordered printed, and when printed to be committed to the Committee on Transportation AN ACT to amend the vehicle and traffic law, in relation to distribution of health care proxy information THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The vehicle and traffic law is amended by adding a new section 397-c to read as follows: S 397-C. DISTRIBUTION OF HEALTH CARE PROXY INFORMATION. THE DEPARTMENT SHALL DISTRIBUTE, IN LICENSE AND VEHICLE REGISTRATION-RELATED MAILINGS TO STATE RESIDENTS, A HEALTH CARE PROXY FORM AND INSTRUCTIONS AS PREPARED BY THE COMMISSIONER OF THE DEPARTMENT OF HEALTH IN COLLAB- ORATION WITH THE COMMISSIONER. THE DEPARTMENT SHALL CONDUCT SUCH MAIL- INGS FOR THE ENTIRE CALENDAR YEAR ONCE EVERY FOUR YEARS. THE FIRST MAIL- ING SHALL COMMENCE ON A SCHEDULE TO BE DETERMINED BY THE COMMISSIONER, BUT SHALL COMMENCE NO LATER THAN THE FIRST OF JANUARY, TWO THOUSAND THIRTEEN. S 2. BILL NUMBER:S2613A TITLE OF BILL: An act to amend the vehicle and traffic law, in relation to health care proxy information on driver's licenses PURPOSE OR GENERAL IDEA OF BILL: The purpose of this legislation is to ,amend the information that may be listed on a driver's license to allow New Yorkers who have completed a health care proxy form to specify their designated health care agent's name and contact information. SUMMARY OF SPECIFIC PROVISIONS: This bill would amend paragraph a of subdivision 1 of section 504 of the vehicle and traffic law. JUSTIFICATION: Individuals deserve to have their health care wishes honored, yet a large majority of New York residents do not have a health care proxy for times when they cannot express their health care preferences. As a result, their wishes are often unknown, and they might be given medical treatment that they would not want or not be given treatment that matches their choices. STAVISKY -- read twice and ordered printed, and when printed to be committed to the Committee on Transportation -- commit- tee discharged, bill amended, ordered reprinted as amended and recom- mitted to said committee AN ACT to amend the vehicle and traffic law, in relation to health care proxy information on driver's licenses THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph (a) of subdivision 1 of section 504 of the vehi- cle and traffic law, as separately amended by chapters 568 and 639 of the laws of 2006, is amended to read as follows: (a) Every license or renewal thereof shall contain a distinguishing mark and adequate space upon which an anatomical gift, pursuant to section forty-three hundred ten of the public health law, by the licen- see shall be recorded and shall contain such other information and shall be issued in such form as the commissioner shall determine; provided, however, every license or renewal thereof issued to a person under the age of twenty-one years shall have prominently imprinted upon it the statement "UNDER 21 YEARS OF AGE" in notably distinctive print or format; provided further, however, every license or renewal thereof issued to a person making an anatomical gift shall have prominently printed upon the front of such license or renewal thereof the statement "ORGAN DONOR" in notably distinctive print or format; AND PROVIDED FURTHER THAT EVERY LICENSE SHALL HAVE IMPRINTED ON THE BACK, "IF YOU HAVE COMPLETED A HEALTH CARE PROXY FORM, YOU MAY LIST YOUR HEALTH CARE AGENT HERE:" FOLLOWED BY SPACE FOR THE HEALTH CARE AGENT'S NAME AND CONTACT INFORMATION. The commissioner shall not require fees for the issuance of such licenses or renewals thereof to persons under twenty- one years of age or to persons making an anatomical gift which are different from the fees required for the issuance of licenses or EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
