BILL NUMBER:S7029 TITLE OF BILL: An act to amend the environmental conservation law, in relation to the classification of certain dredged sediment PURPOSE: To allow for the use of dredged sediment, which has been cleaned and processed, as fill material instead of having to be disposed of in solid waste facilities. SUMMARY OF PROVISIONS: This bill would add a new Title 35 to Article 15 of the Environmental Conservation Law to provide that material which has been dredged or excavated from the waters of this state in accordance with a permit, and which has been cleaned or processed, shall be classified as a beneficial use material and shall not be classified as solid waste. JUSTIFICATION: Dredged sediment is currently being classified as solid waste. As a result, state and local governments must spend a significant amount of money to transport and dispose of such material in solid waste facili- ties. However, much dredged sediment can be cleaned, processed and safe- ly reused. This bill seeks to encourage such beneficial use, where appropriate. This will reduce the costs of dredging projects, and also prove beneficial to development projects which are in need of fill.
