AN ACT to amend the vehicle and traffic law, in relation to tire safety

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  Subdivision  35 of section 375 of the vehicle and traffic
law is amended by adding a new paragraph (d) to read as follows:
  (D) NO MOTOR VEHICLE REPAIR SHOP AS  DEFINED  IN  SUBDIVISION  TWO  OF
SECTION  THREE  HUNDRED NINETY-EIGHT-B OF THIS TITLE SHALL REPAIR A TIRE
THAT WOULD NOT PASS NEW YORK STATE MOTOR VEHICLE INSPECTION AS  REQUIRED
UNDER ARTICLE FIVE OF THIS TITLE. ANY VIOLATION OF THE PROVISION OF THIS
PARAGRAPH SHALL CONSTITUTE AN OFFENSE AND SHALL BE PUNISHABLE BY A CIVIL
FINE OF NOT MORE THAN ONE THOUSAND DOLLARS FOR EACH OFFENSE.
  S 2. This act shall take effect immediately.

AN ACT to amend the vehicle and traffic law, in relation to tire safety

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Subdivision 35 of section 375 of the  vehicle  and  traffic
law is amended by adding a new paragraph (d) to read as follows:
  (D)  NO  MOTOR  VEHICLE  REPAIR  SHOP AS DEFINED IN SUBDIVISION TWO OF
SECTION THREE HUNDRED NINETY-EIGHT-B OF THIS TITLE SHALL REPAIR  A  TIRE
IF  SUCH  TIRE,  AFTER  SUCH REPAIR IS COMPLETE, WOULD NOT MEET NEW YORK
STATE MOTOR VEHICLE INSPECTION STANDARDS ESTABLISHED UNDER ARTICLE  FIVE
OF  THIS  TITLE.  A VIOLATION OF THIS PARAGRAPH SHALL BE PUNISHABLE BY A
CIVIL FINE OF NOT MORE THAN TWO HUNDRED FIFTY DOLLARS FOR EACH OFFENSE.
  S 2. This act shall take effect on the ninetieth day  after  it  shall
have become a law.
