AN ACT to amend the mental hygiene law,  in  relation  to  enacting  the
  "skills  for  direct support professional jobs for the developmentally
  disabled act"

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. This act shall be known and may be cited as the "skills for
direct support professional jobs for the developmentally disabled act".
  S  2.  The mental hygiene law is amended by adding a new section 13.41
to read as follows:
S 13.41 REPORT ON WORKFORCE NEEDS AND CREDENTIAL PRODUCTION.
  1. TO THE EXTENT PRACTICABLE WITHIN AVAILABLE RESOURCES AND SUBJECT TO
THE AVAILABILITY OF DATA CURRENTLY COLLECTED BY AND  ACCESSIBLE  TO  THE
OFFICE,  THE  OFFICE,  IN CONSULTATION WITH THE DEPARTMENT OF LABOR, THE
DEPARTMENT OF EDUCATION, AND ANY OTHER ENTITY THE OFFICE DEEMS APPROPRI-
ATE, SHALL PRODUCE A REPORT REGARDING STATE WORKFORCE  NEED  PROJECTIONS
AND CREDENTIAL PRODUCTION. THE REPORT SHALL:
  (A) INDICATE THE STATE'S ANTICIPATED WORKFORCE NEEDS AND THE NUMBER OF
DEGREES,  CERTIFICATES,  AND  OTHER  CREDENTIALS THAT PUBLIC AND PRIVATE
INSTITUTIONS OF HIGHER EDUCATION, PRIVATE  OCCUPATIONAL  SCHOOLS,  LOCAL
COMMUNITY COLLEGES, AND AREA VOCATIONAL SCHOOLS EXPECT TO ISSUE;
  (B)  TO  THE  EXTENT  PROVIDED  BY SOURCES EXTERNAL TO THE DEPARTMENT,
INDICATE THE STATE'S ANTICIPATED NUMBER OF  DEGREES,  CERTIFICATES,  AND
OTHER  CREDENTIALS  THAT HIGH SCHOOL VOCATIONAL PROGRAMS, APPRENTICESHIP
PROGRAMS, AND OTHER PUBLIC OR PRIVATE WORKFORCE TRAINING PROGRAMS EXPECT
TO ISSUE;
  (C) IDENTIFY ANY WORKFORCE NEEDS, INCLUDING  AREAS  OF  SPECIALIZATION
WITHIN  A  PARTICULAR  VOCATION,  THAT  MAY NOT BE MET BY THE EDUCATION,
TRAINING, AND APPRENTICESHIP PROGRAMS;

 EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets
                      [ ] is old law to be omitted.

  (D) IDENTIFY INSTITUTIONS, PUBLIC OR PRIVATE, THAT MAY MEET  PROJECTED
WORKFORCE NEEDS; AND
  (E)  PROMULGATE  RECOMMENDATIONS  FOR  A  MASTER  PLAN FOR A COURSE OF
STUDYING OFFERING.
  2. THE OFFICE, BY JANUARY FIRST, TWO THOUSAND FOURTEEN, SHALL  PROVIDE
A COPY OF THE REPORT TO THE MENTAL HEALTH AND DEVELOPMENTAL DISABILITIES
COMMITTEE  OF THE SENATE AND ASSEMBLY OR ANY SUCCESSOR COMMITTEE, AND TO
THE GOVERNOR.
  3. THE DEPARTMENT SHALL SEND THE REPORT TO EVERY PUBLIC  POSTSECONDARY
GOVERNING  BOARD  IN  THE  STATE  AND  SHALL WORK WITH THE DEPARTMENT OF
EDUCATION TO PROVIDE THE REPORT TO THE STATE'S PUBLIC SCHOOL  DISTRICTS,
NEW  YORK  CHARTER  SCHOOLS AND NEW YORK PRIVATE ELEMENTARY, MIDDLE, AND
HIGH SCHOOLS.
  S 3. This act shall take effect immediately.

                                BILL NUMBER:S3107A

TITLE OF BILL:  An act to amend the mental hygiene law, in relation to
enacting the "skills for direct support professional jobs for the
developmentally disabled act"

PURPOSE:

The bill requires the Office of People with Developmental Disabilities
in consultation with the Department of Labor, the Department of
Education and any other office deemed appropriate to produce a report
regarding state workforce need projections and credential production
for direct support professional jobs for the developmentally disabled.

SUMMARY OF PROVISIONS:

Section 2 amends mental hygiene law by adding a new section 13.41 to
report on workforce needs and credential production. The report would
include the state's current and anticipated workforce needs over the
next five years as well as the number of degrees, certificates and
other credentials that higher education institutions expect to issue.
The report would also identify any workforce needs and any
institutions that may meet projected needs.

Section 3 makes the bill effective immediately.

JUSTIFICATION:

It has been reported by Clarence Sundram in the report commissioned by
Governor Andrew Cuomo that although there are currently hundreds of
thousands of persons in direct support jobs across all human services
systems there clearly does not exist programs of common validated
skill standards and/or competencies for direct support professional
support workers. This act will project the workforce needs of the
state in the Office of People with Developmental Disabilities and
exhibit workforce needs that are not being met by state degrees and
certificate production and identify institutions, public or private
that can address those workforce needs through new programs or
expansion of existing ones.  Institutions of higher education,
including community colleges, the state university and the city
university are encouraged to use the report in master planning for
course offerings.

  (B) TO THE EXTENT PROVIDED BY  SOURCES  EXTERNAL  TO  THE  DEPARTMENT,
INDICATE  THE  STATE'S  ANTICIPATED NUMBER OF DEGREES, CERTIFICATES, AND
OTHER CREDENTIALS THAT HIGH SCHOOL VOCATIONAL  PROGRAMS,  APPRENTICESHIP

COPY OF THE REPORT TO THE MENTAL HEALTH AND  DEVELOPMENTAL  DISABILITIES
COMMITTEE  OF THE SENATE AND ASSEMBLY OR ANY SUCCESSOR COMMITTEE, AND TO
THE GOVERNOR.
  S 3. This act shall take effect immediately.
