BILL NUMBER:S3107 TITLE OF BILL: An act to amend the mental hygiene law, in relation to enacting the "skills for direct support professional jobs for the devel- opmentally disabled act" PURPOSE: The bill requires the Office of People with Developmental Disabilities in consultation with the Department of Labor, the Depart- ment of Education and any other office deemed appropriate to produce a report regarding state workforce need projections and credential production for direct support professional jobs for the developmentally disabled. SUMMARY OF PROVISIONS: Section 1 amends mental hygiene law by adding a new section 13.41 to report on workforce needs and credential production. Section 2 makes the bill effective immediately. EXISTING LAW: JUSTIFICATION: It has been reported by Clarence Sundram in the report commissioned by Governor Andrew Cuomo that although there are currently hundreds of thousands of persons in direct support jobs across all human services systems there clearly does not exist programs of common vali-

CARLUCCI -- read twice and ordered printed, and when printed to be committed to the Committee on Mental Health and Develop- mental Disabilities AN ACT to amend the mental hygiene law, in relation to enacting the "skills for direct support professional jobs for the developmentally disabled act" THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. This act shall be known and may be cited as the "skills for direct support professional jobs for the developmentally disabled act". S 2. The mental hygiene law is amended by adding a new section 13.41 to read as follows: S 13.41 REPORT ON WORKFORCE NEEDS AND CREDENTIAL PRODUCTION. 1. TO THE EXTENT PRACTICABLE WITHIN AVAILABLE RESOURCES AND SUBJECT TO THE AVAILABILITY OF DATA CURRENTLY COLLECTED BY AND ACCESSIBLE TO THE OFFICE, THE OFFICE, IN CONSULTATION WITH THE DEPARTMENT OF LABOR, THE DEPARTMENT OF EDUCATION, AND ANY OTHER ENTITY THE OFFICE DEEMS APPROPRI- ATE, SHALL PRODUCE A REPORT REGARDING STATE WORKFORCE NEED PROJECTIONS AND CREDENTIAL PRODUCTION. THE REPORT SHALL: (A) INDICATE THE STATE'S ANTICIPATED WORKFORCE NEEDS AND THE NUMBER OF DEGREES, CERTIFICATES, AND OTHER CREDENTIALS THAT PUBLIC AND PRIVATE INSTITUTIONS OF HIGHER EDUCATION, PRIVATE OCCUPATIONAL SCHOOLS, LOCAL COMMUNITY COLLEGES, AND AREA VOCATIONAL SCHOOLS EXPECT TO ISSUE; (B) TO THE EXTENT PROVIDED BY SOURCES EXTERNAL TO THE DEPARTMENT, INDICATE THE STATE'S ANTICIPATED NUMBER OF DEGREES, CERTIFICATES, AND OTHER CREDENTIALS THAT HIGH SCHOOL VOCATIONAL PROGRAMS, APPRENTICESHIP PROGRAMS, AND OTHER PUBLIC OR PRIVATE WORKFORCE TRAINING PROGRAMS EXPECT TO ISSUE; (C) IDENTIFY ANY WORKFORCE NEEDS, INCLUDING AREAS OF SPECIALIZATION WITHIN A PARTICULAR VOCATION, THAT MAY NOT BE MET BY THE EDUCATION, TRAINING, AND APPRENTICESHIP PROGRAMS; EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. The report would include the state's current and anticipated workforce needs over the next five years as well as the number of degrees, certificates and other credentials that higher education institutions expect to issue. The report would also identify any workforce needs and any institutions that may meet projected needs. Section 3 makes the bill effective immediately.
