BILL NUMBER:S4712 TITLE OF BILL: An act to amend the education law, in relation to requiring a study and report on the total cost of developing all student assessments PURPOSE OR GENERAL IDEA OF BILL: This legislation directs the State Education Department to review and analyze the costs associated with statewide assessments in school districts in New York State. SUMMARY OF SPECIFIC PROVISIONS: Section 1 amends the Education law to direct the commissioner to undertake a study about the costs of developing and administering student assessments. Section 2 directs the commissioner to conduct a survey of school administrators and teachers about the effect of student assessments on teaching and learning. JUSTIFICATION: This bill calls for a review and analysis of the costs associated with statewide assessments of students in school districts throughout the stare. Testing costs money and time and therefore requires resources. Over the past several years, there has been an increased emphasis on testing to evaluate student progress. The question is: has the increased emphasis on testing captured more state and local resources, has this affected other aspects of education including classroom teaching, college and career preparation and special services to students with special needs and, if so, how? LATIMER -- read twice and ordered printed, and when printed to be committed to the Committee on Education AN ACT to amend the education law, in relation to requiring a study and report on the total cost of developing all student assessments THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 305 of the education law is amended by adding a new subdivision 43 to read as follows: 43. A. THE COMMISSIONER SHALL UNDERTAKE A STUDY TO DETERMINE THE TOTAL COST OF DEVELOPING ALL STUDENT ASSESSMENTS, INCLUDING THE TOTAL COST OF PREPARING STUDENTS FOR ALL ASSESSMENTS, THE TOTAL COST OF ADMINISTERING ALL ASSESSMENTS, AND THE TOTAL COST OF GRADING AND REVIEWING ALL ASSESS- MENTS IN THE TWO THOUSAND TWELVE -- TWO THOUSAND THIRTEEN SCHOOL YEAR. B. THIS STUDY REQUIRED PURSUANT TO PARAGRAPH A OF THIS SUBDIVISION SHALL RESULT IN A REPORT, WHICH DETAILS ALL SAID COSTS AND SHALL BE FILED WITH THE GOVERNOR, THE DIRECTOR OF THE DIVISION OF THE BUDGET, THE SPEAKER OF THE ASSEMBLY, THE TEMPORARY PRESIDENT OF THE SENATE, THE CHAIR OF THE ASSEMBLY WAYS AND MEANS COMMITTEE, THE CHAIR OF THE SENATE FINANCE COMMITTEE AND THE CHAIRS OF THE ASSEMBLY AND SENATE EDUCATION COMMITTEES. SUCH REPORT SHALL ALSO BE POSTED ON THE WEBSITE OF THE DEPARTMENT BY DECEMBER THIRTY-FIRST, TWO THOUSAND THIRTEEN AND SHALL BE DEEMED A PUBLIC DOCUMENT. C. THE COMMISSIONER'S STUDY SHALL INCLUDE, BUT NOT BE LIMITED TO, THE FOLLOWING INFORMATION: (1) THE TOTAL NUMBER OF STUDENT ASSESSMENTS ADMINISTERED IN EACH SCHOOL DISTRICT IN THE STATE. THIS SHALL INCLUDE A COUNT OF STATE REQUIRED ASSESSMENTS AND ASSESSMENTS WHICH ARE LOCALLY OR COMMERCIALLY DEVELOPED ASSESSMENTS WHICH ARE ADMINISTERED BY PUBLIC SCHOOL DISTRICTS AND THE TOTAL NUMBER OF ASSESSMENTS EACH STUDENT COHORT WAS ADMINISTERED ON AVERAGE FROM KINDERGARTEN THROUGH GRADE TWELVE DURING THE TWO THOU- SAND TWELVE -- TWO THOUSAND THIRTEEN SCHOOL YEAR; EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
