BILL NUMBER:S7286 TITLE OF BILL: An act to amend the executive law, in relation to establishing a methamphetamine manufacturer registry PURPOSE OR GENERAL IDEA OF BILL: To create the "Methamphetamine Manufacturer Registry act" which would require that all those convicted of manufacturing methamphetamine in New York State to register where their place of residence in a directory to be maintained by the Division of Criminal Justice Services. SUMMARY OF SPECIFIC PROVISIONS: Section 1 provides for a short title of "Methamphetamine Manufacturer Registry Act" Section 2 amends the executive law by adding a new section 837-s to establish a Methamphetamine Manufacturer registry to be maintained by the Division of Criminal Justice Services for the purpose of identifying persons convicted of manufacturing methamphetamine, which would include their name, date of birth, offenses leading to convictions, date and locations of convictions, and any additional information that DCJS deems necessary to identify the individual. This information should be made publicly available via the internet by DCJS.

ESPAILLAT -- read twice and ordered printed, and when printed to be committed to the Committee on Finance AN ACT to amend the executive law, in relation to establishing a meth- amphetamine manufacturer registry THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Short title. This act shall be known and may be cited as the "methamphetamine manufacturer registry act". S 2. The executive law is amended by adding a new section 837-s to read as follows: S 837-S. METHAMPHETAMINE MANUFACTURER REGISTRY. 1. (A) THE DIVISION SHALL ESTABLISH AND MAINTAIN A METHAMPHETAMINE MANUFACTURER REGISTRY FOR THE PURPOSE OF IDENTIFYING PERSONS CONVICTED OF MANUFACTURING METHAMPHE- TAMINE, AS SET FORTH IN SUBDIVISION TWO OF THIS SECTION. THE METHAMPHE- TAMINE MANUFACTURER REGISTRY SHALL CONTAIN SUCH INDIVIDUAL'S NAME, DATE OF BIRTH, OFFENSE OR OFFENSES REQUIRING INCLUSION IN THE METHAMPHETAMINE MANUFACTURER REGISTRY, THE CONVICTION DATE AND COUNTY OF EACH SUCH OFFENSE, AND SUCH OTHER IDENTIFYING INFORMATION AS THE DIVISION DEEMS NECESSARY TO IDENTIFY SUCH INDIVIDUAL, BUT SHALL NOT INCLUDE THE SOCIAL SECURITY NUMBER OF SUCH PERSON. (B) THE DIVISION SHALL MAKE THE INFORMATION CONTAINED IN THE REGISTRY ACCESSIBLE TO THE PUBLIC AND ON THE INTERNET THROUGH THE DIVISION'S WEBSITE. THE DIVISION SHALL UPDATE INFORMATION AS IT DEEMS NECESSARY. (C) THE DIVISION SHALL PROMULGATE RULES AND REGULATIONS NECESSARY TO IMPLEMENT THIS SECTION WHICH SHALL INCLUDE PROCEDURES TO ENSURE THAT THE INFORMATION IN THE REGISTRY IS ACCURATE, AND THAT THE INFORMATION IN THE REGISTRY REFLECTS ANY CHANGES BASED ON THE REVERSAL OF A CONVICTION FOR AN OFFENSE REQUIRING INCLUSION IN THE METHAMPHETAMINE MANUFACTURER REGISTRY, OR A COURT ORDER REQUIRING THE SEALING OR EXPUNGEMENT OF RECORDS RELATING TO THE OFFENSE. A CERTIFIED COPY OF SUCH AN ORDER SHALL BE DEEMED PRIMA FACIE TRUE AND CORRECT AND, SHALL BE SUFFICIENT TO REQUIRE THE IMMEDIATE AMENDMENT OR REMOVAL OF ANY PERSON'S INFORMATION FROM THE REGISTRY.
