BILL NUMBER: S6234 TITLE OF BILL : An act to amend the education law, in relation to creating mandatory continuing education for teachers relating to mental health issues PURPOSE : Relates to creating mandatory continuing education for teachers relating to mental health issues. SUMMARY OF PROVISIONS : § 3001-e. Mandatory continuing education for teacher; mental health issues. 1. The commissioner shall, in consultation with the commissioner of health and the commissioner of mental health, create and administer a mandatory continuing education course for teachers relating to mental health issues. Such commissioners are authorized to make any determinations necessary for the implementation of such education course. 2. Every teacher qualified to teach pursuant to section three thousand one of this article, shall comply with the provisions of the mandatory continuing education requirements of this section. Teachers who do not satisfy the mandatory continuing education requirements shall not teach until they have met such requirements and have been issued a certificate of completion. 3. The continuing education program shall train teachers to accomplish safe

The education law is amended by adding a new section 3001-e to read as follows: S 3001-E. MANDATORY CONTINUING EDUCATION FOR TEACHERS; MENTAL HEALTH ISSUES. 1. THE COMMISSIONER SHALL, IN CONSULTATION WITH THE COMMISSIONER OF HEALTH AND THE COMMISSIONER OF MENTAL HEALTH, CREATE AND ADMINISTER A MANDATORY CONTINUING EDUCATION COURSE FOR TEACHERS RELATING TO MENTAL HEALTH ISSUES. SUCH COMMISSIONERS ARE AUTHORIZED TO MAKE ANY DETERMI- NATIONS NECESSARY FOR THE IMPLEMENTATION OF SUCH EDUCATION COURSE. 2. EVERY TEACHER QUALIFIED TO TEACH PURSUANT TO SECTION THREE THOUSAND ONE OF THIS ARTICLE, SHALL COMPLY WITH THE PROVISIONS OF THE MANDATORY CONTINUING EDUCATION REQUIREMENTS OF THIS SECTION. THE CONTINUING EDUCATION PROGRAM SHALL TRAIN TEACHERS TO ACCOMPLISH SAFE DE-ESCALATION OF CRISIS SITUATIONS, RECOGNITION OF THE SIGNS AND SYMPTOMS OF MENTAL ILLNESS, AND TIMELY REFERRAL TO MENTAL HEALTH SERVICES, THE EARLY STAGES OF DEVELOPING MENTAL DISORDERS. THE PROGRAM SHALL ALSO PROVIDE ADDITIONAL RESOURCES NECESSARY FOR TEACHERS TO ASSIST STUDENTS IN CRISIS TO CONNECT WITH APPROPRIATE LOCAL MENTAL HEALTH CARE SERVICES, TRAINING ON MENTAL HEALTH RESOURCES, INCLUDING THE LOCATION OF COMMUNITY MENTAL HEALTH CENTERS IN THE STATE AND LOCAL COMMUNITY, AND TRAINING ON ACTIONS PLANS AND PROTOCOLS FOR REFERRAL TO SUCH RESOURCES. 4. SUCH PROGRAM SHALL BE MADE AVAILABLE TO TEACHERS SEMIANNUALLY, HOWEVER TEACHERS SHALL BE REQUIRED TO ONLY ATTEND ANNUALLY, PROVIDED THAT THEY ARE ISSUED A REGISTRATION CERTIFICATE UPON COMPLETION. TEACH- ERS SHALL MAINTAIN ADEQUATE DOCUMENTATION OF COMPLETION OF CONTINUING EDUCATION PURSUANT TO THIS SECTION AND SHALL PROVIDE SUCH DOCUMENTATION AT THE REQUEST OF THE DEPARTMENT.

HAMILTON, COMRIE, PERSAUD -- read twice and ordered printed, and when printed to be committed to the Committee on Educa- tion -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee AN ACT to amend the education law, in relation to mandatory continuing education for teachers relating to mental health issues THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph a of subdivision 2 of section 3006-a of the education law, as added by section 2 of subpart C of part EE of chapter 56 of the laws of 2015, is amended to read as follows: a. During each five-year registration period beginning on or after July first, two thousand sixteen, an applicant for registration shall successfully complete a minimum of one hundred hours of continuing teacher and leader education, as defined by the commissioner. SUCH CONTINUING TEACHER AND LEADER EDUCATION SHALL INCLUDE AT LEAST TWICE DURING THE FIVE-YEAR REGISTRATION PERIOD, BUT NOT BE LIMITED TO, CONTIN- UING EDUCATION COURSES, PROGRAMS, AND ACTIVITIES RELATED TO MENTAL HEALTH. SUCH TRAINING SHALL INCLUDE BEST PRACTICES FOR THE SAFE DE-ESCA- LATION OF CRISIS SITUATIONS, AND IDENTIFYING SIGNS AND SYMPTOMS, INCLUD- ING THE EARLY STAGES, OF MENTAL ILLNESSES AND SITUATIONS THAT MAY NECES- SITATE TIMELY NOTIFICATION TO APPROPRIATE SCHOOL OFFICIALS. The department shall issue rigorous standards for courses, programs, and activities[,] that shall qualify as continuing teacher and leader educa- tion pursuant to this section. For purposes of this section, a peer review teacher, or a principal acting as an independent trained evalu- ator, conducting a classroom observation as part of the teacher evalu- ation system pursuant to section three thousand twelve-d of this article may credit such time towards his or her continuing teacher and leader effectiveness requirements.
