BILL NUMBER: S5964 TITLE OF BILL : An act to amend the vehicle and traffic law, in relation to the operation of a motor vehicle by deaf or hard of hearing drivers PURPOSE : To amend the vehicle and traffic law, in relation to the operation of a motor vehicle by a deaf or hard of hearing driver SUMMARY OF PROVISIONS : Section 1: Amends the vehicle and traffic law by adding a new section 1229-e. Section 2: enacting clause JUSTIFICATION : Given that driving is a visual activity and a deaf person is incapable of hearing even with a hearing aide, the restriction of requiring a hearing aide to drive makes little sense. This bill would lift that unnecessary restriction upon the deaf community and require only that the driver have the sufficient visibility to operate their vehicle safely. LEGISLATIVE HISTORY :

ROBACH -- read twice and ordered printed, and when printed to be committed to the Committee on Transportation AN ACT to amend the vehicle and traffic law, in relation to the opera- tion of a motor vehicle by deaf or hard of hearing drivers THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The vehicle and traffic law is amended by adding a new section 1229-e to read as follows: § 1229-E. OPERATION OF A MOTOR VEHICLE BY DEAF OR HARD OF HEARING DRIVERS. NO DEAF OR HARD OF HEARING DRIVER SHALL BE REQUIRED TO WEAR A HEARING AID WHILE OPERATING A MOTOR VEHICLE IN THIS STATE PROVIDED THAT SUCH DEAF OR HARD OF HEARING DRIVER'S VEHICLE IS EQUIPPED WITH A FULL VIEW MIRROR. § 2. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD11532-01-7
