BILL NUMBER: S776 TITLE OF BILL : An act to amend the education law, in relation to increasing the cap on earnings for eligible individuals with no dependents receiving tuition assistance program awards PURPOSE OF BILL : Relates to increasing the cap to $30,000 on earnings for eligible individuals with no dependents receiving TAP awards. SUMMARY OF PROVISIONS : Section 1. Item 2 of clause (A) of subparagraph (iii) of paragraph a of subdivision 667 of the education law, as amended by section 3 of part H of chapter 58 of the laws 2011. JUSTIFICATION : The current max earning for a single, independent undergraduate student with no tax dependents receiving TAP awards is currently $10,000 according to Education Law Section 667 (3)(a) (iii)(A). A young adult who no longer lives with his/her parents that earns $15,000 annually, for instance, does not qualify for TAP despite

CARLUCCI -- read twice and ordered printed, and when printed to be committed to the Committee on Higher Education AN ACT to amend the education law, in relation to increasing the cap on earnings for eligible individuals with no dependents receiving tuition assistance program awards THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Item 2 of clause (A) of subparagraph (iii) of paragraph a of subdivision 3 of section 667 of the education law, as amended by section 3 of part H of chapter 58 of the laws of 2011, is amended to read as follows: (2) Three thousand dollars or Thirty-one per centum of more, but not more than [ten] amount in excess of three THIRTY thousand dollars thousand dollars § 2.
