 AN ACT to amend the penal law, in relation to  making  the  theft  of  a
   package  intentionally  taken from a porch, driveway, doorway or other
   area adjacent to the residence of another following  delivery  of  the
   package to such residence by the postal service or a commercial carri-
   er a felony
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Section 155.30 of the penal law is amended by adding a  new
 subdivision 5-a to read as follows:
   5-A.  THE PROPERTY CONSISTS OF A PACKAGE, REGARDLESS OF ITS NATURE AND
 VALUE OF SUCH   PACKAGE, WHICH IS  INTENTIONALLY  TAKEN  FROM  A  PORCH,
 DRIVEWAY,  DOORWAY  OR  OTHER  AREA ADJACENT TO THE RESIDENCE OF ANOTHER
 FOLLOWING DELIVERY OF THE  PACKAGE  TO  SUCH  RESIDENCE  BY  THE  POSTAL
 SERVICE OR A COMMERCIAL CARRIER; OR
   § 2. This act shall take effect on the first of November next succeed-
 ing the date upon which it shall have become a law.
