BILL NUMBER: S6794 SPONSOR: JORDAN TITLE OF BILL: An act to amend the penal law, in relation to making the theft of a package intentionally taken from a porch, driveway, door- way or other area adjacent to the residence of another following deliv- ery of the package to such residence by the postal service or a commer- cial carrier a felony SUMMARY OF PROVISIONS: Section 1 Amends section 155.30 of the penal law to add subdivision 5-a to allow that the property that consists of a package, regardless of its nature and value of such package, which is intentionally taken from a porch, driveway, doorway or other area adjacent to the residence of another following delivery of the package to such residence by the postal service or a commercial carrier, to be a felony. Section 2 sets forth the effective date. JUSTIFICATION:

JORDAN -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the penal law, in relation to making the theft of a package intentionally taken from a porch, driveway, doorway or other area adjacent to the residence of another following delivery of the package to such residence by the postal service or a commercial carri- er a felony THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 155.30 of the penal law is amended by adding a new subdivision 5-a to read as follows: 5-A. THE PROPERTY CONSISTS OF A PACKAGE, REGARDLESS OF ITS NATURE AND VALUE OF SUCH PACKAGE, WHICH IS INTENTIONALLY TAKEN FROM A PORCH, DRIVEWAY, DOORWAY OR OTHER AREA ADJACENT TO THE RESIDENCE OF ANOTHER FOLLOWING DELIVERY OF THE PACKAGE TO SUCH RESIDENCE BY THE POSTAL SERVICE OR A COMMERCIAL CARRIER; OR § 2. This act shall take effect on the first of November next succeed- ing the date upon which it shall have become a law.
