BILL NUMBER: S5032 SPONSOR: HOYLMAN TITLE OF BILL: An act to amend the public health law, in relation to embryo and pre-embryo banks and storage facilities PURPOSE OR GENERAL IDEA OF BILL: Human embryos and pre-embryos are added to the definition of tissues covered by the tissue bank and storage facility licensing law and the quality standards such facilities must follow are specified. SUMMARY OF SPECIFIC PROVISIONS: Section 1 amends subdivision 10 of Section 4360 of the public health law to add embryo and pre-embryo to the definition of tissues covered by the tissue bank and storage facility licensing law. Section 2 creates a new subdivision 6 is added to Section 4364 of the public health law to lists the specific quality standards that tissue bank and storage facilities must follow for human embryos and pre-embr-

HOYLMAN -- read twice and ordered printed, and when printed to be committed to the Committee on Health AN ACT to amend the public health law, in relation to embryo and pre-em- bryo banks and storage facilities THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 10 of section 4360 of the public health law, as added by chapter 589 of the laws of 1990, is amended to read as follows: 10. "Tissue" means a human eye, skin, bone, bone marrow, heart valve, spermatozoon, ova, PRE-EMBRYO, EMBRYO, artery, vein, tendon, ligament, pituitary gland or a fluid other than blood or a blood derivative. § 2. Section 4364 of the public health law is amended by adding a new subdivision 6 to read as follows: 6. ALL EMBRYO AND PRE-EMBRYO BANKS OR STORAGE FACILITIES SHALL COMPLY WITH REGULATIONS TO BE PROMULGATED BY THE COMMISSIONER THAT MAY INCORPO- RATE STANDARDS ISO 9001 AND ISO 20387 OF THE INTERNATIONAL ORGANIZATION FOR STANDARDIZATION, THE STANDARDS FOR BIOREPOSITORIES ESTABLISHED BY THE INTERNATIONAL SOCIETY FOR BIOLOGICAL AND ENVIRONMENTAL REPOSITORIES AND BY THE COLLEGE OF AMERICAN PATHOLOGISTS BIOREPOSITORY ACCREDITATION PROGRAM, AND THE UNITED STATES FOOD AND DRUG ADMINISTRATION GUIDANCE ON "CURRENT GOOD TISSUE PRACTICES". § 3. This act shall take effect immediately; provided, however that section two of this act shall take effect on the first of January next succeeding the date on which it shall have become a law. Effective imme- diately, the addition, amendment and/or repeal of any rule or regulation necessary for the implementation of this act on its effective date are authorized to be made and completed on or before such effective date.
