BILL NUMBER: S5050 SPONSOR: COMRIE TITLE OF BILL: An act to amend the public authorities law, in relation to capital program plans PURPOSE OR GENERAL IDEA OF BILL: Relates to changing the date of submission of the capital program plan to the capital program review board. SUMMARY OF PROVISIONS: Amends section 1269-b of public authorities law to add a new paragraph (d) and amend paragraphs (b) and (c). A paragraph (e) is also added so that each capital program plan is submitted a year before it will take effect. JUSTIFICATION:

S T A T E O F N E W Y O R K ________________________________________________________________________ 5050 2019-2020 Regular Sessions I N S E N A T E April 4, 2019 ___________ Introduced by Sen. COMRIE -- read twice and ordered printed, and when printed to be committed to the Committee on Transportation AN ACT to amend the public authorities law, in relation to capital program plans THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraphs (b) and (c) of subdivision 1 of section 1269-b of the public authorities law, as added by chapter 637 of the laws of 1996, are amended and two new paragraphs (d) and (e) are added to read as follows: (b) not later than ten days after the effective date of this paragraph the authority shall submit to the metropolitan transportation authority capital program review board two capital program plans for the five-year period commencing January first, nineteen hundred ninety-five; [and] (c) on or before October first, nineteen hundred ninety-nine and every fifth year thereafter, the authority shall submit to the metropolitan transportation authority capital program review board two capital program plans for the five-year period commencing January first of the following year[.]; AND (D) ON AND AFTER JANUARY FIRST, TWO THOUSAND TWENTY, THE AUTHORITY SHALL SUBMIT TO THE METROPOLITAN TRANSPORTATION AUTHORITY CAPITAL PROGRAM REVIEW BOARD ON OR BEFORE JANUARY THIRTY-FIRST, TWO THOUSAND TWENTY-FOUR AND EVERY FIFTH YEAR THEREAFTER, TWO CAPITAL PROGRAM PLANS FOR THE FIVE-YEAR PERIOD COMMENCING JANUARY FIRST OF THE FOLLOWING YEAR. (E) NOTWITHSTANDING ANY PROVISION OF LAW TO THE CONTRARY, THE CAPITAL PROGRAM PLANS REQUIRED TO BE SUBMITTED TO THE METROPOLITAN TRANSPORTA- TION AUTHORITY CAPITAL PROGRAM REVIEW BOARD BY THE AUTHORITY SHALL BE SUBMITTED ON OR BEFORE JANUARY THIRTY-FIRST OF THE YEAR PRIOR TO THE PERIOD FOR WHICH THE SUBMITTED CAPITAL PROGRAM PLANS TAKE PLACE. § 2.
