TITLE OF BILL:

An act to amend part JJJ of chapter 59 of the laws of 2019 amending the
criminal procedure law relating to the issuance of securing orders, in
relation to the effectiveness thereof; to amend part KKK of chapter 59
of the laws of 2019 amending the criminal procedure law relating to time
limits for a speedy trial, in relation to the effectiveness thereof; and
to amend part LLL of chapter 59 of the laws of 2019 amending the crimi-
nal procedure law and the penal law relating to establishing new crimi-
nal discovery rules, in relation to the effectiveness thereof

 
PURPOSE:  Postpones until January 1, 2021 the effectiveness of certain
provisions relating to the issuance of securing orders, to time limits
for a speedy trial, and to establishing new criminal discovery rules.

 
SUMMARY OF PROVISIONS:

Section 1. Section 25 of part JJJ of chapter 59 of the laws of 2019

amending the criminal procedure law relating to the issuance of securing
orders is amended to read as follows:

25. This act shall take effect on January 1, (2020) 2021. § 2. Section 2
of part KKK of chapter 59 of the laws of 2019 amending the criminal
procedure law relating to time limits for a speedy trial is amended to
read as follows:

§ 2. This act shall take effect January 1, (2020) 2021.

3. Section 14 of part LLL of chapter 59 of the laws of 2019 amending the
criminal procedure law and the penal law relating to establishing new
criminal discovery rules is amended to read as follows:

§ 14. This act shall take effect January 1, (2020) 2021; provided,
however, the amendments to section 65.20 of the criminal procedure law
made by section four of this act shall not affect the repeal of such
section and shall be deemed repealed therewith.

 
JUSTIFICATION:

This legislation was crafted to hit the pause button on the far-reaching
bail and discovery reform legislation that was hastily passed earlier
this year and is scheduled to take effect on January 1, 2020. The bill
seeks a one-year moratorium on the implementation of these reforms.

Such a delay will provide adequate time for statewide hearings to be
held in all 10 regions of the state so that criminal justice experts and
stakeholders including district attorneys, law enforcement, victims,
victims' advocates and domestic violence prevention advocates and other
citizens can weigh in on the initiative's potential risks to public
safety.

Additionally, this timeframe will enable us as lawmakers to further
evaluate costs associated with implementation and appropriate funds for
this unfunded mandate being passed down to our local law enforcement
entities.

 AN  ACT to amend part JJJ of chapter 59 of the laws of 2019 amending the
   criminal procedure law relating to the issuance of securing orders, in
   relation to the effectiveness thereof; to amend part KKK of chapter 59
   of the laws of 2019 amending the criminal procedure  law  relating  to
   time limits for a speedy trial, in relation to the effectiveness ther-
   eof;  and to amend part LLL of chapter 59 of the laws of 2019 amending
   the criminal procedure law and the penal law relating to  establishing
   new criminal discovery rules, in relation to the effectiveness thereof
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Section 25 of part JJJ of chapter 59 of the  laws  of  2019
 amending the criminal procedure law relating to the issuance of securing
 orders is amended to read as follows:
   § 25. This act shall take effect on January 1, [2020] 2021.
   §  2. Section 2 of part KKK of chapter 59 of the laws of 2019 amending
 the criminal procedure law relating to time limits for a speedy trial is
 amended to read as follows:
   § 2. This act shall take effect January 1, [2020] 2021.
   § 3. Section 14 of part LLL of chapter 59 of the laws of 2019 amending
 the criminal procedure law and the penal law  relating  to  establishing
 new criminal discovery rules is amended to read as follows:
   §  14.  This  act  shall take effect January 1, [2020] 2021; provided,
