BILL NUMBER: S7229 SPONSOR: MAY TITLE OF BILL: An act to amend the general municipal law, in relation to Internet access and communications for municipalities PURPOSE: This bill affirmatively establishes the right of counties, cities, towns, and villages in New York State to establish municipal broadband services by establishing their own service or by contracting with a corporation to do so. SUMMARY OF PROVISIONS: Section 1: adds a new section 99-x to the general municipal law to authorize and empower county, cities, towns, and villages to establish or contract for broadband and related telecommunications infrastructure if their governing bodies determine that this will make internet access

MAY -- read twice and ordered printed, and when printed to be committed to the Committee on Local Government AN ACT to amend the general municipal law, in relation to Internet access and communications for municipalities THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The general municipal law is amended by adding a new section 99-x to read as follows: § 99-X. INTERNET ACCESS AND COMMUNICATIONS. THE GOVERNING BODY OF ANY COUNTY, CITY, TOWN OR VILLAGE IS HEREBY AUTHORIZED AND EMPOWERED TO ESTABLISH, CONSTRUCT, AND MAINTAIN BROADBAND AND RELATED TELECOMMUNI- CATIONS INFRASTRUCTURE, OR TO CONTRACT FOR THE CONSTRUCTION AND MAINTE- NANCE OF SUCH SERVICES WITH A CORPORATION, AND FOR THE MAINTENANCE, CARE, AND REPLACEMENT OF INFRASTRUCTURE IN CONNECTION THEREWITH, IF SUCH GOVERNING BODY FINDS THAT SUCH FACILITIES ARE NECESSARY TO MAKE AVAIL- ABLE INTERNET ACCESS AND RELATED SERVICES THAT ARE NOT AND WILL NOT BE AVAILABLE THROUGH OTHER PROVIDERS OR THE PRIVATE MARKET IN THE REASON- ABLY FORESEEABLE FUTURE. § 2.
