BILL NUMBER: S594 SPONSOR: MAY TITLE OF BILL: An act to amend the general municipal law, in relation to Internet access and communications for municipalities PURPOSE: This bill affirmatively establishes the right of counties, cities, towns, and villages in New York State to establish municipal broadband services by establishing their own service or by contracting with a corporation to do so. SUMMARY OF PROVISIONS: Section 1: amends the general municipal law to authorize and empower county, cities, towns, and villages to establish or contract for broad- band and related telecommunications infrastructure if their governing bodies determine it is a necessity.

THE GOVERNING BODY OF ANY COUNTY, CITY, TOWN OR VILLAGE IS HEREBY AUTHORIZED AND EMPOWERED TO ESTABLISH, CONSTRUCT, AND MAINTAIN BROADBAND AND RELATED TELECOMMUNI- CATIONS INFRASTRUCTURE, OR TO CONTRACT FOR THE CONSTRUCTION AND MAINTE- NANCE OF SUCH SERVICES WITH A CORPORATION, AND FOR THE MAINTENANCE, CARE, AND REPLACEMENT OF INFRASTRUCTURE IN CONNECTION THEREWITH, IF SUCH GOVERNING BODY FINDS THAT SUCH FACILITIES ARE NECESSARY. § 2.
