BILL NUMBER: S7377 Revised 2/25/2020 SPONSOR: STEWART-COUSINS TITLE OF BILL: An act to amend the executive law, in relation to establishing an inter- agency task force on hate crimes and domestic terrorism PURPOSE OR GENERAL IDEA OF BILL: This legislation creates a task force that shall collect and organize data related to hate crimes and domestic terrorism, on an interagency level. The task force will evaluate any available federal, state, and local programs to aid victims of domestic terrorism and victims of hate crimes, and will establish the best protocol and other recommendations between agencies to prevent hate crimes and domestic terrorism and improve the efficiency of currently existing programs. STEWART-COUSINS -- read twice and ordered printed, and when printed to be committed to the Committee on Investigations and Government Operations AN ACT to amend the executive law, in relation to establishing an inter- agency task force on hate crimes and domestic terrorism THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The executive law is amended by adding a new section 234 to read as follows: § 234. ESTABLISHMENT OF INTERAGENCY TASK FORCE ON HATE CRIMES AND DOMESTIC TERRORISM. 1. THERE IS ESTABLISHED AN INTERAGENCY TASK FORCE ON HATE CRIMES AND DOMESTIC TERRORISM, WHICH SHALL CONSIST OF THE FOLLOWING MEMBERS OR THEIR DESIGNEES: (A) THE SUPERINTENDENT OF STATE POLICE; (B) THE COMMISSIONER OF THE DIVISION OF CRIMINAL JUSTICE SERVICES; (C) THE COMMISSIONER OF THE DIVISION OF HOMELAND SECURITY AND EMERGENCY SERVICES; (D) THE DIRECTOR OF THE OFFICE OF VICTIM SERVICES; (E) THE DIRECTOR OF THE DIVISION OF HUMAN RIGHTS; (F) ONE MEMBER, WHO SHALL BE APPOINTED BY THE GOVERNOR AS A REPRESENTATIVE OF A GROUP OR GROUPS OF PEOPLE WHO HAVE BEEN TARGETED BY HATE CRIME ACTS OR ACTS OF DOMESTIC TERRORISM; (G) ONE MEMBER, WHO SHALL BE APPOINTED BY THE GOVERNOR AS A REPRESENTATIVE OF A GROUP OR GROUPS WHO ADVOCATE FOR OR OTHERWISE REPRE- SENT COMMUNITIES WHO HAVE BEEN TARGETED BY HATE CRIME ACTS OR ACTS OF DOMESTIC TERRORISM; (H) ONE MEMBER, WHO SHALL BE APPOINTED ON THE RECOM- MENDATION OF THE TEMPORARY PRESIDENT OF THE SENATE; (I) ONE MEMBER, WHO SHALL BE APPOINTED ON THE RECOMMENDATION OF THE SPEAKER OF THE ASSEMBLY; (J) ONE MEMBER, WHO SHALL BE APPOINTED ON THE RECOMMENDATION OF THE PRESIDENT OF THE NEW YORK STATE DISTRICT ATTORNEYS ASSOCIATION; (K) ONE MEMBER, WHO SHALL BE APPOINTED ON THE RECOMMENDATION OF THE PRESIDENT OF THE NEW YORK STATE ASSOCIATION OF CHIEFS OF POLICE; AND OTHERS AS MAY BE NECESSARY TO CARRY OUT THE DUTIES AND RESPONSIBILITIES UNDER THIS SECTION. THE TASK FORCE WILL BE CO-CHAIRED BY THE COMMISSIONER OF THE DIVISION OF CRIMINAL JUSTICE SERVICES AND THE SUPERINTENDENT OF STATE POLICE, OR THEIR DESIGNEES. IT SHALL MEET AS OFTEN AS IS NECESSARY, BUT NO LESS THAN FOUR TIMES PER YEAR, AND UNDER CIRCUMSTANCES AS ARE APPRO- EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets
