GOUNARDES -- read twice and ordered printed, and when printed to be committed to the Committee on Transportation AN ACT to amend the vehicle and traffic law, in relation to creating a pedestrian safety rating system for motor vehicles THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The vehicle and traffic law is amended by adding a new section 216-b to read as follows: § 216-B. PEDESTRIAN SAFETY RATING SYSTEM. THE COMMISSIONER SHALL CAUSE TO BE CREATED A PEDESTRIAN SAFETY RATING SYSTEM WHICH SHALL BE MADE PUBLICLY AVAILABLE ON THE DEPARTMENT'S INTERNET WEBSITE. SUCH PEDESTRIAN SAFETY RATING SYSTEM SHALL PROVIDE A RATING BETWEEN ONE AND FIVE STARS FOR EVERY MOTOR VEHICLE MODEL REGISTERED BY INDIVIDUALS IN THIS STATE BASED ON: 1. THE FREQUENCY OF COLLISIONS INVOLVING A BICYCLIST OR PEDESTRIAN REPORTED IN THE STATE FOR SUCH MOTOR VEHICLE MODEL, COMPARED TO THE TOTAL NUMBER OF SUCH MOTOR VEHICLE MODEL REGISTERED IN THE STATE; 2. SAFETY FEATURES THAT THE COMMISSIONER DETERMINES ARE RELEVANT TO PEDESTRIAN AND BICYCLIST SAFETY, INCLUDING BUT NOT LIMITED TO, AUTOMATIC COLLISION WARNING OR PEDESTRIAN DETECTION FEATURES, AUTOMATIC BRAKING, AND VISIBILITY; AND 3. ANY OTHER FACTORS THE COMMISSIONER DETERMINES ARE RELEVANT TO PEDESTRIAN AND BICYCLIST SAFETY. § 2. This act shall take effect immediately.
