   KRUEGER, MYRIE, RIVERA, SALAZAR, SEPULVEDA, STAVISKY -- read twice and
   ordered printed, and when printed to be committed to the Committee  on
   Transportation

 AN  ACT  to amend the vehicle and traffic law, in relation to creating a
   pedestrian safety rating system for motor vehicles
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  The  vehicle  and  traffic law is amended by adding a new
 section 216-b to read as follows:
   § 216-B. PEDESTRIAN SAFETY RATING SYSTEM FOR MOTOR VEHICLE MODELS.  1.
 THE  COMMISSIONER  SHALL  CAUSE TO BE CREATED A PEDESTRIAN SAFETY RATING
 SYSTEM FOR EVERY MOTOR VEHICLE MODEL REGISTERED BY INDIVIDUALS  IN  THIS
 STATE  WHICH SHALL BE MADE PUBLICLY AVAILABLE ON THE DEPARTMENT'S INTER-
 NET WEBSITE. SUCH PEDESTRIAN SAFETY RATING SYSTEM SHALL PROVIDE A RATING
 BETWEEN ONE AND FIVE STARS FOR EVERY MOTOR VEHICLE MODEL BASED ON:
   (A) THE FREQUENCY OF COLLISIONS AND NUMBER AND  SEVERITY  OF  INJURIES
 RESULTING  FROM  SUCH  COLLISIONS INVOLVING A BICYCLIST OR PEDESTRIAN AS
 REPORTED IN THE STATE FOR SUCH MOTOR  VEHICLE  MODEL,  COMPARED  TO  THE
 TOTAL NUMBER OF SUCH MOTOR VEHICLE MODEL REGISTERED IN THE STATE;
   (B)  SAFETY  FEATURES THAT THE COMMISSIONER DETERMINES ARE RELEVANT TO
 PEDESTRIAN AND BICYCLIST SAFETY, INCLUDING BUT NOT LIMITED TO, AUTOMATIC
 COLLISION WARNING OR PEDESTRIAN DETECTION FEATURES,  AUTOMATIC  BRAKING,
 AND VISIBILITY; AND
   (C)  ANY  OTHER  FACTORS  THE  COMMISSIONER DETERMINES ARE RELEVANT TO
 PEDESTRIAN AND BICYCLIST SAFETY.
   2. THE COMMISSIONER SHALL  ISSUE  REGULATIONS  TO  ALL  MOTOR  VEHICLE
 MANUFACTURERS,  DEALERS, BROKERS, DISTRIBUTORS, AND OTHER BUSINESS ENTI-
 TIES REQUIRED TO REGISTER IN SECTION FOUR HUNDRED FIFTEEN OF THIS  ARTI-
 CLE  TO  REQUIRE  SUCH  ENTITIES  TO  ADOPT THE PEDESTRIAN SAFETY RATING
