TITLE OF BILL:

An act to amend the penal law, in relation to establishing the misdemea-
nor of unlawful concealment of identity; and providing for the repeal of
such provisions upon expiration thereof

 
PURPOSE OR GENERAL IDEA OF BILL:

Establishes the misdemeanor of unlawful concealment of identity.

 
SUMMARY OF PROVISIONS:

§ 1. The penal law is amended by adding a new section 240.11 to read as
follows:

§ 240.11 Unlawful concealment of identity.

A person is guilty of unlawful concealment of identity when he or she

wears any mask, false whiskers or any personal disguise, whether
complete or partial, for the purpose of:

1. evading or escaping discovery, recognition or identification in the
commission of any crime; or

2. concealment, flight or escape, when charged with, arrested for or
convicted of, any crime.  Any person violating any of the provisions of
this section shall be deemed guilty of a misdemeanor.

 
JUSTIFICATION:

While citizens throughout New York State and elsewhere are practicing
mitigation by wearing masks to protect themselves and others from the
spread of COVID-19, an unintended consequence of this action has been a
sharp rise in armed robberies and burglaries.  This legislation estab-
lishes the misdemeanor of unlawful concealment of identity. Sanitary
measures to protect the public when a pandemic strikes should not incen-
tivize unscrupulous activity.

EFFECTIVE DATE:
This act shall take effect immediately and shall expire and be deemed
repealed December 31, 2020.

 AN ACT to amend the penal law, in relation to establishing the misdemea-
   nor of unlawful concealment of identity; and providing for the  repeal
   of such provisions upon expiration thereof
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. The penal law is amended by adding a new section 240.11  to
 read as follows:
 § 240.11 UNLAWFUL CONCEALMENT OF IDENTITY.
   A  PERSON IS GUILTY OF UNLAWFUL CONCEALMENT OF IDENTITY WHEN HE OR SHE
 WEARS ANY  MASK,  FALSE  WHISKERS  OR  ANY  PERSONAL  DISGUISE,  WHETHER
 COMPLETE OR PARTIAL, FOR THE PURPOSE OF:
   1. EVADING OR ESCAPING DISCOVERY, RECOGNITION OR IDENTIFICATION IN THE
 COMMISSION OF ANY CRIME; OR
   2.  CONCEALMENT,  FLIGHT OR ESCAPE, WHEN CHARGED WITH, ARRESTED FOR OR
 CONVICTED OF, ANY CRIME.
   ANY PERSON VIOLATING ANY OF THE PROVISIONS OF THIS  SECTION  SHALL  BE
 DEEMED GUILTY OF A MISDEMEANOR.
   §  2.  This  act shall take effect immediately and shall expire and be
 deemed repealed December 31, 2020.
