S T A T E O F N E W Y O R K ________________________________________________________________________ 2105 2021-2022 Regular Sessions I N A S S E M B L Y January 14, 2021 ___________ Introduced by M. of A. FERNANDEZ -- read once and referred to the Committee on Codes AN ACT to amend the criminal procedure law, in relation to preventing temporary questioning of person solely because such person is wearing a mask during a state emergency for an epidemic or pandemic THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 140.50 of the criminal procedure law is amended by adding a new subdivision 5 to read as follows: 5. NO PERSON SHALL BE SUBJECT TO TEMPORARY QUESTIONING SOLELY BECAUSE SUCH PERSON IS WEARING A MASK DURING A STATE EMERGENCY FOR AN EPIDEMIC OR PANDEMIC. § 2. This act shall take effect immediately.
