Provides that where mandatory continuing education programs are offered through electronic or other remote means where the licensee must provide proof of attendance by responding to a visual or auditory prompt in the program, such program shall provide a sufficient length of time for a person with a visual or other impairment to be able to view and respond to such prompt or direction.

EPSTEIN -- read once and referred to the Commit- tee on Higher Education AN ACT to amend the education law, in relation to remote programs for mandatory continuing education THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The education law is amended by adding a new section 6505-d to read as follows: § 6505-D. REMOTE PROGRAMS FOR MANDATORY CONTINUING EDUCATION. 1. WHENEVER THE PRACTICE OF A PROFESSION WHICH IS LICENSED BY THE STATE, INCLUDING THE PRACTICE OF LAW AS GOVERNED BY THE CHIEF ADMINISTRATOR OF THE COURT OF APPEALS AND THE RULES OF THE APPELLATE DIVISION OF THE SUPREME COURT, SHALL REQUIRE THE COMPLETION OF MANDATORY CONTINUING EDUCATION, ANY PROGRAM DESIGNED AND APPROVED TO FULFILL SUCH REQUIREMENT WHICH IS OFFERED TO BE DELIVERED ELECTRONICALLY OR BY OTHER REMOTE MEANS WHERE THE LICENSEE MUST PROVIDE PROOF OF ATTENDANCE BY RESPONDING TO A VISUAL OR AUDITORY PROMPT IN THE PROGRAM, SHALL PROVIDE A SUFFICIENT LENGTH OF TIME FOR A PERSON WITH A VISUAL OR OTHER DISABILITY TO BE ABLE TO VIEW AND RESPOND TO SUCH PROMPT OR DIRECTION. ALL REMOTE PROGRAMS FOR MANDATORY CONTINUING EDUCATION SHALL CONFORM TO THE MOST RECENT GUIDE- LINES FOR WEBSITE CONTENT ACCESSIBILITY GUIDELINES (WCAG). 2. A CIVIL PENALTY OF ONE THOUSAND DOLLARS MAY BE IMPOSED FOR EACH VIOLATION OF THIS SECTION. § 2. This act shall take effect on the thirtieth day after it shall have become a law.
