MILLER, BLANK- ENBUSH, LAWLER, SMITH, GALLAHAN, BYRNES, ANGELINO, MORINELLO, BRABE- NEC, DeSTEFANO, SALKA -- read once and referred to the Committee on Local Governments AN ACT to amend the general municipal law, in relation to prohibiting municipal corporations from adopting local laws, ordinances, regu- lations, or policies that prohibit certain utility services from being delivered based on the type or source of energy THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The general municipal law is amended by adding a new section 99-x to read as follows: § 99-X. PROHIBITIONS RELATING TO UTILITY SERVICE. 1. FOR THE PURPOSES OF THIS SECTION, "UTILITY SERVICE" SHALL MEAN NATURAL GAS, PROPANE, FUEL OIL, OR OTHER FOSSIL FUELS PROVIDED TO A CUSTOMER. 2. THE GOVERNING BOARD OF A MUNICIPAL CORPORATION SHALL NOT ADOPT ANY LOCAL LAW, ORDINANCE, REGULATION OR POLICY THAT PROHIBITS, OR HAS THE EFFECT OF PROHIBITING, THE CONNECTION OR RECONNECTION OF A UTILITY SERVICE TO A CUSTOMER BASED UPON THE TYPE OR SOURCE OF ENERGY TO BE DELIVERED TO SUCH CUSTOMER. § 2.
