BILL NUMBER: S7467 SPONSOR: ORTT TITLE OF BILL: An act to amend the general municipal law, in relation to prohibiting municipal corporations from adopting local laws, ordinances, regu- lations, or policies that prohibit certain utility services from being delivered based on the type or source of energy PURPOSE OR GENERAL IDEA OF BILL: To allow consumers to make informed decisions with regard to their ener- gy choices SUMMARY OF PROVISIONS: Section 1. Amends the General Municipal Law by adding a new section 99-x prohibiting local municipalities from taking action that would ban a utility connection based on the type or source of energy delivered. Section 2. Establishes an immediate effective date.

ORTT, AKSHAR, GALLIVAN, MATTERA, OBERACKER, STEC -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the general municipal law, in relation to prohibiting municipal corporations from adopting local laws, ordinances, regu- lations, or policies that prohibit certain utility services from being delivered based on the type or source of energy THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The general municipal law is amended by adding a new section 99-x to read as follows: § 99-X. PROHIBITIONS RELATING TO UTILITY SERVICE. 1. FOR THE PURPOSES OF THIS SECTION, "UTILITY SERVICE" SHALL MEAN NATURAL GAS, PROPANE, FUEL OIL, OR OTHER FOSSIL FUELS PROVIDED TO A CUSTOMER. 2. THE GOVERNING BOARD OF A MUNICIPAL CORPORATION SHALL NOT ADOPT ANY LOCAL LAW, ORDINANCE, REGULATION OR POLICY THAT PROHIBITS, OR HAS THE EFFECT OF PROHIBITING, THE CONNECTION OR RECONNECTION OF A UTILITY SERVICE TO A CUSTOMER BASED UPON THE TYPE OR SOURCE OF ENERGY TO BE DELIVERED TO SUCH CUSTOMER. § 2.
