S T A T E O F N E W Y O R K ________________________________________________________________________ 9192 I N A S S E M B L Y February 9, 2022 ___________ Introduced by M. of A. PALMESANO -- read once and referred to the Committee on Environmental Conservation AN ACT to amend the environmental conservation law, in relation to educating the public about the health and environmental impacts of lithium-ion batteries for electric vehicles, and the manufacturing thereof THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph b of subdivision 2 of section 19-0301 of the environmental conservation law is amended to read as follows: b. Encourage voluntary cooperation by all persons in controlling air, WATER AND SOIL pollution and air, WATER AND SOIL contamination, INCLUD- ING, BUT NOT LIMITED TO, EDUCATING THE PUBLIC ABOUT THE HEALTH AND ENVI- RONMENTAL IMPACTS OF LITHIUM-ION BATTERY USE AND MANUFACTURE, SUCH AS TOXICITY AND CONTAMINATION RESULTANT FROM BATTERY LEAKAGE OR DETERI- ORATION, ENVIRONMENTAL IMPACTS OF LITHIUM-ION BATTERY CASUALTIES AND DISPOSAL AND HEALTH RISKS ASSOCIATED WITH EXPOSURE TO LITHIUM-ION BATTERY COMPONENTS. THE DEPARTMENT SHALL ALSO CONSIDER THE ENVIRON- MENTAL, HEALTH AND SAFETY FACTORS ASSOCIATED WITH EXTREME-HEAT LITHIUM BATTERY FIRES, AND EFFECTS ON THE EQUIPMENT, HEALTH AND SAFETY OF FIRST RESPONDERS IN THE EVENT OF AN EXTREME-HEAT BATTERY CASUALTY. SUCH EDUCA- TION SHALL, AT A MINIMUM, INCLUDE DEVELOPING AND DISTRIBUTING EDUCA- TIONAL MATERIALS AND POSTING SUCH INFORMATION ON THE DEPARTMENT'S WEBSITE. § 2.
