DURSO, GALLAHAN, BYRNES, GANDOLFO, DeSTEFANO, McDONOUGH, MORINELLO, TAGUE, ANGELINO, BRABENEC, HAWLEY, LEMONDES, BROWN, MANKTELOW, JENSEN, COLTON, SIMPSON, MIKULIN, BUTTENSCHON -- read once and referred to the Committee on Codes AN ACT to amend the penal law, in relation to the unlawful discharge of a loaded firearm toward any police officer, firefighter, corrections officer, peace officer, or emergency medical services personnel THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 265.35 of the penal law is amended by adding a new subdivision 4 to read as follows: 4. ANY PERSON WHO WILLFULLY DISCHARGES A LOADED FIREARM OR ANY OTHER GUN, THE PROPELLING FORCE OF WHICH IS GUNPOWDER, WHILE POINTED OR AIMED AT A PEACE OFFICER, POLICE OFFICER, CORRECTIONS OFFICER, FIREFIGHTER OR EMERGENCY MEDICAL SERVICES PROFESSIONAL, WITH OR WITHOUT MALICE, IS GUILTY OF A CLASS B FELONY. § 2. This act shall take effect on the thirtieth day after it shall have become a law. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD14516-01-2
