BILL NUMBER: S5739 SPONSOR: PALUMBO TITLE OF BILL: An act to amend the penal law, in relation to the unlawful discharge of a loaded firearm toward any police officer, firefighter, corrections officer, peace officer, or emergency medical services personnel PURPOSE: Any individual who shoots a gun at a peace officer, police officer, corrections officer, firefighter or emergency medical services profes- sional is guilty of a class B felony SUMMARY OF PROVISIONS: Section 1. Section 265.35 of the penal law is amended by adding a new subdivision 4 to read as follows: Any person who willfully discharges a loaded firearm or any other gun, the propelling force of which is gunpowder while pointed or aimed at a peace officer, police officer, corrections officer, firefighter or emergency medical services profes-

PALUMBO -- read twice and ordered printed, and when printed to be committed to the Committee on Codes AN ACT to amend the penal law, in relation to the unlawful discharge of a loaded firearm toward any police officer, firefighter, corrections officer, peace officer, or emergency medical services personnel THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 265.35 of the penal law is amended by adding a new subdivision 4 to read as follows: 4. ANY PERSON WHO WILLFULLY DISCHARGES A LOADED FIREARM OR ANY OTHER GUN, THE PROPELLING FORCE OF WHICH IS GUNPOWDER, WHILE POINTED OR AIMED AT A PEACE OFFICER, POLICE OFFICER, CORRECTIONS OFFICER, FIREFIGHTER OR EMERGENCY MEDICAL SERVICES PROFESSIONAL, WITH OR WITHOUT MALICE, IS GUILTY OF A CLASS B FELONY. § 2.
