2021-S3303 (ACTIVE) - Summary

Provides that every person who has served in more than one time of war shall be entitled to additional credit as a veteran or disabled veteran in competitive examinations for original appointment or promotion for every such time of war during which person served, regardless of whether any such person has utilized such credit for a competitive examination for original appointment or a competitive examination for promotion.

TITLE OF BILL:

An act to amend the civil service law, in relation to the use of credits
for veterans and disabled veterans

 
PURPOSE:

To allow the use of additional credits allowed to veterans and disabled
veterans on Civil Service examinations. This legislation would allow a
person who has served during more than one time of war to utilize addi-
tional credit regardless of whether the veteran or disabled veteran has
previously utilized veterans' credits for original appointment or for
promotion.

 
SUMMARY OF PROVISIONS:

This bill will add a new Section 4.(e) to Section 85 of the Civil
Service Law which will allow for additional Civil Service credits for

veterans who served in more than one time of war.

 
EXISTING LAW:

Currently, a veteran who has served in more than one time of war is
prohibited from receiving additional credits for the additional service.

 
JUSTIFICATION:

This bill would allow additional credit to a veteran who has received
"veterans credit" previously on a Civil Service examination and who
subsequently answered the call to duty during an additional time of war.
This bill would reward those who have served in more than one conflict
and it provides an incentive for our citizens to continue participating
in the reserve components of our armed forces.

 AN ACT to amend the civil service law, in relation to the use of credits
   for veterans and disabled veterans

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  Subdivision  4  of section 85 of the civil service law is
 amended by adding a new paragraph (e) to read as follows:
   (E) EVERY PERSON WHO HAS SERVED IN MORE THAN ONE TIME OF WAR SHALL  BE
 ENTITLED  TO THE ADDITIONAL CREDIT PROVIDED HEREIN AS A VETERAN OR DISA-
 BLED VETERAN, IN COMPETITIVE EXAMINATIONS FOR  ORIGINAL  APPOINTMENT  OR
 PROMOTION  FOR  EVERY  SUCH TIME OF WAR DURING WHICH SUCH PERSON SERVED,
 REGARDLESS OF WHETHER ANY SUCH PERSON HAS UTILIZED  SUCH  CREDIT  FOR  A
 COMPETITIVE  EXAMINATION FOR ORIGINAL APPOINTMENT OR A COMPETITIVE EXAM-
 INATION FOR PROMOTION.
   § 2. This act shall take effect immediately.
