BILL NUMBER: S3507 SPONSOR: BAILEY TITLE OF BILL: An act to amend the public health law, in relation to requiring inspections for Legionnaires' disease in certain locations PURPOSE OF BILL: To create mandatory annual inspections in certain living facilities for Legionnaires' disease by the department of health to prevent future outbreaks. SUMMARY OF SPECIFIC PROVISIONS: Section. 1 amends Article 21 of the public health law by adding title 8, which includes Legionnaires disease to the list of acute communicable diseases the department of health shall guard against. Section 2 provides the effective date.

BAILEY, ADDABBO, MYRIE, PERSAUD -- read twice and ordered printed, and when printed to be committed to the Committee on Health AN ACT to amend the public health law, in relation to requiring inspections for Legionnaires' disease in certain locations THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Article 21 of the public health law is amended by adding a new title 9 to read as follows: TITLE IX LEGIONNAIRES' DISEASE SECTION 2190. LEGIONNAIRES' DISEASE; DEFINITIONS. 2191. LEGIONNAIRES' DISEASE; INSPECTIONS. § 2190. LEGIONNAIRES' DISEASE; DEFINITIONS. FOR THE PURPOSES OF THIS TITLE, THE TERM "LOCATION" SHALL MEAN ANY ENCLOSED OR OUTDOOR SPACE WHICH COULD BE SUSCEPTIBLE TO LEGIONNAIRES' DISEASE INCLUDING, BUT NOT LIMITED TO, APARTMENT COMPLEXES, APARTMENT BUILDINGS, SENIOR CENTERS, MULTI-UNIT LIVING COMMUNITIES, BUILDINGS OR FACILITIES, BATHS, SPAS, RESTROOMS, RESTAURANTS, AND GROCERY STORES. § 2191. LEGIONNAIRES' DISEASE; INSPECTIONS. EACH LOCATION WHICH THE COMMISSIONER DETERMINES IS SUSCEPTIBLE TO LEGIONNAIRES' DISEASE SHALL SUBMIT TO AN ANNUAL INSPECTION BY THE DEPARTMENT FOR THE PRESENCE OF LEGIONNAIRES' DISEASE. § 2.
