 Introduced by Sen. SEPULVEDA -- read twice and ordered printed, and when
   printed  to  be committed to the Committee on Crime Victims, Crime and
   Correction
 
 AN ACT to amend the correction law, in relation  to  amending  the  term
   residential  treatment  facility;  and  to  repeal  subdivision  10 of
   section 73 of the correction law relating thereto

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  Subdivision  6  of  section  2  of the correction law, as
 amended by chapter 476 of the laws  of  1970,  is  amended  to  read  as
 follows:
   6.  "Residential treatment facility". A correctional facility consist-
 ing of a community based residence in or near a community where  employ-
 ment,  educational  and training opportunities are readily available for
 persons who [are on parole or conditional release and for  persons  who]
 are  or  who  will  soon be eligible for release on parole who intend to
 reside in or near that community when released.
   § 2. Subdivision 10 of section 73 of the correction law is REPEALED.
   § 3. This act shall take effect on the thirtieth day  after  it  shall
 have become a law.
