BILL NUMBER: S790 SPONSOR: KAPLAN TITLE OF BILL: An act to amend the vehicle and traffic law, in relation to waiving the annual service fee for distinctive "September eleventh, two thousand one remembrance" license plates for certain first responders PURPOSE OR GENERAL IDEA OF BILL: This legislation would allow for the waiving of the annual service fee for distinctive "September eleventh, two thousand one remembrance" license plates for certified first responders who are disabled as a result of a certified World Trade Center medical condition. SUMMARY OF PROVISIONS: Section one of this bill amends subdivision 2 of section 404-ee of the vehicle and traffic law by adding "certified first responders" of the September eleventh, two thousand one attacks who have become disabled as

KAPLAN -- read twice and ordered printed, and when printed to be committed to the Committee on Transportation AN ACT to amend the vehicle and traffic law, in relation to waiving the annual service fee for distinctive "September eleventh, two thousand one remembrance" license plates for certain first responders THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 2 of section 404-ee of the vehicle and traffic law, as added by chapter 224 of the laws of 2018, is amended to read as follows: 2. A distinctive plate issued pursuant to this section shall be issued in the same manner as other number plates upon the payment of the regu- lar registration fee prescribed by section four hundred one of this article; provided, however, that an additional annual service charge of twenty-five dollars shall be charged for such plates, EXCEPT THAT SUCH ADDITIONAL ANNUAL SERVICE CHARGE SHALL BE WAIVED FOR ANY CERTIFIED FIRST RESPONDER WHO IS DISABLED AS A RESULT OF A CERTIFIED WORLD TRADE CENTER MEDICAL CONDITION. § 2. BILL NUMBER: S790A SPONSOR: KAPLAN TITLE OF BILL: An act to amend the vehicle and traffic law, in relation to waiving certain fees for distinctive "September eleventh, two thousand one remembrance" license plates for certain first responders PURPOSE OR GENERAL IDEA OF BILL: This legislation would allow for the waiving of fees for the distinctive "September eleventh, two thousand one remembrance" license plates for certified first responders who are disabled, or their spouses as a result of a certified World Trade Center medical condition. SUMMARY OF PROVISIONS: Section one of this bill adds a new subdivi- sion 4 to section 401-ee of the vehicle and traffic law by adding language to allow fees prescribed for the issuance and renewal of a license note to a person who sustained a permanent disability as a result of their participation in the rescue effort on 9/11, or their spouse to be waived.

Section 404-ee of the vehicle and traffic law, as added by chapter 224 of the laws of 2018, is amended by adding a new subdivision 4 to read as follows: 4. (A) NOTWITHSTANDING SUBDIVISION TWO OF THIS SECTION AND THE FEES PRESCRIBED OR PERMITTED BY SECTION FOUR HUNDRED ONE OF THIS ARTICLE, THERE SHALL BE NO CHARGE FOR THE ISSUANCE OF A NUMBER PLATE PURSUANT TO THIS SECTION TO A PERSON WHO SUSTAINED A PERMANENT DISABILITY AS A RESULT OF HIS OR HER PARTICIPATION IN THE RESCUE EFFORT THAT WAS CONDUCTED IN RESPONSE TO THE WORLD TRADE CENTER ATTACK ON SEPTEMBER ELEVENTH, TWO THOUSAND ONE, OR TO THE SPOUSE OF A PERSON WHO SUSTAINED A PERMANENT DISABILITY OR DIED AS A RESULT OF SUCH RESCUE EFFORT. FURTHER- MORE, UPON THE ISSUANCE OF A DISTINCTIVE PLATE PURSUANT TO THIS SECTION, SUCH PERSON SHALL BE EXEMPT FROM THE PAYMENT OF ANY FEES RELATING TO THE REGISTRATION OR RENEWAL THEREOF AS PRESCRIBED BY SECTION FOUR HUNDRED ONE OF THIS ARTICLE. (B) THE FEES AUTHORIZED PURSUANT TO THIS SECTION SHALL BE WAIVED ONLY UPON PROOF, SATISFACTORY TO THE COMMISSIONER, THAT THE APPLICANT OR THE SPOUSE OF THE APPLICANT IS ELIGIBLE FOR SUCH WAIVER OF FEES. § 2. This act shall take effect on the sixtieth day after it shall have become a law.
