BILL NUMBER: S8879 SPONSOR: PERSAUD TITLE OF BILL: An act to amend the public health law, in relation to ensuring ovarian cancer survivors have the right to access screenings for health condi- tions PURPOSE OR GENERAL IDEA OF BILL: The purpose of the bill is to expand preventative health care to patients with a personal or family history of ovarian cancer. SUMMARY OF PROVISIONS: Section 1 of the bill adds a new § 2404-e to the public health law to ensure patients with a history of ovarian cancer, the right to have screenings in order to improve their health care in regards to ovarian cancer. Section 2 of the bill is the effective date.

PERSAUD -- read twice and ordered printed, and when printed to be committed to the Committee on Women's Issues AN ACT to amend the public health law, in relation to ensuring ovarian cancer survivors have the right to access screenings for health condi- tions THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The public health law is amended by adding a new section 2404-e to read as follows: § 2404-E. OVARIAN CANCER; RIGHT TO SCREENINGS. NO PERSON WITH A PERSONAL HISTORY OF OVARIAN CANCER SHALL BE DENIED GENETIC TESTING OR GENOMIC TUMOR PROFILING FOR INHERITED GERMLINE MUTATIONS AND ACQUIRED SOMATIC MUTATIONS, RESPECTIVELY. IN GENERAL, SUCH TESTING SHALL NOT BE SUBJECT TO FREQUENCY CAPS OR OTHER LIMITATIONS AND SHALL INCLUDE, BUT NOT BE LIMITED TO: (A) GENETIC MUTATIONS IN BRCA1 AND BRCA2 GENES; (B) GENETIC MUTATIONS ASSOCIATED WITH LYNCH SYNDROME; (C) REARRANGEMENT ANALYSIS OF ALL CODING EXONS ASSOCIATED WITH OVARIAN CANCER; AND (D) ADDITIONAL MUTATIONS IF MEDICALLY NECESSARY AND APPROPRIATE, AS DETERMINED BY THE HEALTH CARE PROFESSIONAL TREATING THE INDIVIDUAL. § 2.
