Prohibits a court from bifurcating the primary elections for members of the state and county committees and assembly district leaders and associate district leaders and all other party positions to be elected and all nominations for public office required to be made at a primary election in such year, except presidential primaries.

Bichotte Hermelyn) -- read once and referred to the Committee on Election Law AN ACT to amend the election law, in relation to prohibiting a court from bifurcating certain primary elections THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 8-100 of the election law is amended by adding a new subdivision 5 to read as follows: 5. (A) NO COURT SHALL ISSUE AN ORDER CHANGING THE DATE OF A PRIMARY ELECTION WHICH BIFURCATES THE OFFICES AND POSITIONS TO BE ELECTED AND NOMINATIONS TO BE MADE AS PART OF THE SAME PRIMARY ELECTION PURSUANT TO PARAGRAPH (A) OF SUBDIVISION ONE OF THIS SECTION. (B) THE PROVISIONS OF THIS SUBDIVISION SHALL NOT APPLY TO ANY PRESI- DENTIAL PRIMARY. § 2. This act shall take effect immediately.
