 AN ACT to amend the vehicle and traffic law, in  relation  to  mandating
   the  use of intelligent speed assistance systems in certain registered
   motor vehicles in the state
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  Section  375 of the vehicle and traffic law is amended by
 adding a new subdivision 58 to read as follows:
   58. (A) AS USED IN  THIS  SUBDIVISION,  THE  TERM  "INTELLIGENT  SPEED
 ASSISTANCE  SYSTEM"  SHALL MEAN AN INTEGRATED VEHICLE SYSTEM THAT DETER-
 MINES THE SPEED LIMIT OF THE ROADWAY THAT THE VEHICLE  IS  TRAVELING  ON
 AND, WHEN THE VEHICLE BEGINS MOVING IN EXCESS OF TEN MILES PER HOUR OVER
 SUCH SPEED LIMIT, ALERTS THE DRIVER IN A MANNER WHICH SHALL INCLUDE, BUT
 NOT BE LIMITED TO, A BRIEF, ONE-TIME VISUAL AND AUDIO SIGNAL.
   (B)  EVERY  MOTOR VEHICLE REGISTERED IN THIS STATE AND MANUFACTURED OR
 ASSEMBLED ON OR AFTER JANUARY FIRST, TWO THOUSAND TWENTY-NINE  SHALL  BE
 EQUIPPED WITH AN INTELLIGENT SPEED ASSISTANCE SYSTEM; PROVIDED, HOWEVER,
 THIS SUBDIVISION SHALL NOT APPLY TO:
   (I)  A  MOTOR  VEHICLE WITH A GROSS VEHICLE WEIGHT RATING GREATER THAN
 EIGHTY-FIVE HUNDRED POUNDS WHICH A FEDERAL MOTOR VEHICLE SAFETY STANDARD
 OF ANY KIND OR CHARACTER EXISTS REQUIRING EITHER THE PASSIVE  OR  ACTIVE
 CONTROL OF SPEED;
   (II) A MOTORCYCLE;
   (III) A BICYCLE WITH ELECTRIC ASSIST;
   (IV)  A MOTOR VEHICLE WHICH IS NOT EQUIPPED WITH EITHER A GLOBAL POSI-
 TIONING SYSTEM OR A FRONT-FACING CAMERA; OR
   (V) AN AUTHORIZED EMERGENCY VEHICLE.
   (C) IF AN INTELLIGENT SPEED  ASSISTANCE  SYSTEM  RECEIVES  CONFLICTING
 SPEED  LIMITS  FOR  THE  SAME  AREA, THE SYSTEM SHALL UTILIZE THE HIGHER
 SPEED LIMIT.
   § 2. This act shall take effect immediately.
