SAYEGH -- read once and referred to the Committee on Higher Education AN ACT to amend the public health law, in relation to permitting specialist assistants to prescribe controlled substances as a practi- tioner THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The public health law is amended by adding a new section 3712 to read as follows: § 3712. PRESCRIPTIONS FOR CONTROLLED SUBSTANCES. A REGISTERED SPECIALIST ASSISTANT, IN GOOD FAITH AND ACTING WITHIN HIS OR HER LAWFUL SCOPE OF PRACTICE, AND TO THE EXTENT ASSIGNED BY HIS OR HER SUPERVISING PHYSICIAN, MAY PRESCRIBE CONTROLLED SUBSTANCES AS A PRACTITIONER UNDER ARTICLE THIRTY-THREE OF THIS CHAPTER, TO PATIENTS UNDER THE CARE OF SUCH PHYSICIAN RESPONSIBLE FOR HIS OR HER SUPERVISION. THE COMMISSIONER, IN CONSULTATION WITH THE COMMISSIONER OF EDUCATION, MAY PROMULGATE SUCH REGULATIONS AS ARE NECESSARY TO CARRY OUT THE PURPOSES OF THIS SECTION. § 2. This act shall take effect on the one hundred eightieth day after it shall have become a law. Effective immediately, the addition, amend- ment and/or repeal of any rule or regulation necessary for the implemen- tation of this act on its effective date are authorized to be made and completed on or before such effective date.
