 AN  ACT  to  amend  the  public  health  law,  in relation to permitting
   specialist assistants to prescribe controlled substances as a  practi-
   tioner
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. The public health law is amended by adding  a  new  section
 3712 to read as follows:
   §  3712.  PRESCRIPTIONS  FOR  CONTROLLED  SUBSTANCES.    A  REGISTERED
 SPECIALIST ASSISTANT, IN GOOD FAITH AND ACTING WITHIN THEIR LAWFUL SCOPE
 OF PRACTICE, AND TO THE EXTENT ASSIGNED BY THEIR SUPERVISING  PHYSICIAN,
 MAY  PRESCRIBE  CONTROLLED  SUBSTANCES  AS  A PRACTITIONER UNDER ARTICLE
 THIRTY-THREE OF THIS CHAPTER, TO PATIENTS UNDER THE CARE OF SUCH  PHYSI-
 CIAN  RESPONSIBLE  FOR THEIR SUPERVISION. THE COMMISSIONER, IN CONSULTA-
 TION WITH THE COMMISSIONER OF EDUCATION, MAY PROMULGATE SUCH REGULATIONS
 AS ARE NECESSARY TO CARRY OUT THE PURPOSES OF THIS SECTION.
   § 2. This act shall take effect on the one hundred eightieth day after
 it shall have become a law. Effective immediately, the addition,  amend-
 ment and/or repeal of any rule or regulation necessary for the implemen-
 tation  of  this act on its effective date are authorized to be made and
 completed on or before such effective date.
