BILL NUMBER: S459 SPONSOR: SEPULVEDA TITLE OF BILL: An act to amend the executive law, in relation to procedures for the conduct of the work of the state board of parole PURPOSE: Provides that the Board of Parole shall grant parole to an inmate who successfully completes two or more years of a temporary release program. SUMMARY OF PROVISIONS: Section 1 amends section 259-i(2) of the executive law to provide that an inmate who successfully completes two years in a temporary release program shall be released to parole. Section 2 provides for an effective date. This act shall take effect immediately.

SEPULVEDA -- read twice and ordered printed, and when printed to be committed to the Committee on Crime Victims, Crime and Correction AN ACT to amend the executive law, in relation to procedures for the conduct of the work of the state board of parole THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 2 of section 259-i of the executive law is amended by adding a new paragraph (f) to read as follows: (F) NOTWITHSTANDING THE REQUIREMENTS OF PARAGRAPH (A) OF THIS SUBDIVI- SION, AN INCARCERATED INDIVIDUAL WHO HAS SUCCESSFULLY PARTICIPATED IN A TEMPORARY RELEASE PROGRAM FOR TWO YEARS WITHOUT INTERRUPTION IMMEDIATELY PRIOR TO HIS OR HER BOARD APPEARANCE SHALL BE GRANTED PAROLE. § 2. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD00231-01-3
