BILL NUMBER: S493 SPONSOR: COMRIE TITLE OF BILL: An act to amend the public service law, in relation to responsibility for cable bills after a disconnection or downgrade in service PURPOSE OR GENERAL IDEA OF BILL: This bill would provide a cable company customer the option to receive a prorated refund or billing in the event of a disconnection or downgrade. SUMMARY OF PROVISIONS: Section one of the bill amends 224-b of the public service law as it relates to limiting the services of a cable company customer is liable for to services incurred up to a requested disconnection or downgrade of service. A customer would be entitled to receive a prorated refund for a disconnection or a billing credit for a downgrade. Section two of the bill relates to the effective date.

COMRIE -- read twice and ordered printed, and when printed to be committed to the Committee on Energy and Telecommuni- cations AN ACT to amend the public service law, in relation to responsibility for cable bills after a disconnection or downgrade in service THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 224-b of the public service law is amended by adding a new subdivision 3 to read as follows: 3. IF A CUSTOMER REQUESTS A DISCONNECTION FROM SERVICE OR A DOWNGRADE IN SERVICE FROM A CABLE TELEVISION COMPANY, THE CUSTOMER SHALL ONLY BE LIABLE FOR SERVICES INCURRED UP TO SUCH DATE THE DISCONNECTION OR DOWN- GRADE IS EFFECTIVE. CUSTOMERS THAT HAVE PAID IN ADVANCE FOR THE BILLING PERIOD WHEN THE DISCONNECTION OR DOWNGRADE OCCURRED SHALL BE ENTITLED TO, ON A PRO RATA BASIS, A REFUND, OR IN THE EVENT OF A DOWNGRADE, A BILLING CREDIT. § 2.
