BILL NUMBER: S2153 SPONSOR: COMRIE TITLE OF BILL: An act to amend the public service law, in relation to responsibility for cable bills after a disconnection or downgrade in service PURPOSE OR GENERAL IDEA OF BILL: This bill would provide a cable company customer the option to receive a prorated refund or billing in the event of a disconnection or downgrade. SUMMARY OF PROVISIONS: Section one of the bill amends 224-b of the public service law as it relates to limiting the services of a cable company customer is liable for to services incurred up to a requested disconnection or downgrade of service. A customer would be entitled to receive a prorated refund for a disconnection or a billing credit for a downgrade. Section two of the bill relates to the effective date.

COMRIE, JACKSON, WEBB -- read twice and ordered printed, and when printed to be committed to the Committee on Energy and Telecommunications AN ACT to amend the public service law, in relation to responsibility for cable bills after a disconnection or downgrade in service THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 224-b of the public service law is amended by adding a new subdivision 3 to read as follows: 3. IF A CUSTOMER REQUESTS A DISCONNECTION FROM SERVICE OR A DOWNGRADE IN SERVICE FROM A CABLE TELEVISION COMPANY, THE CUSTOMER SHALL ONLY BE LIABLE FOR SERVICES INCURRED UP TO SUCH DATE THE DISCONNECTION OR DOWN- GRADE IS EFFECTIVE. CUSTOMERS THAT HAVE PAID IN ADVANCE FOR THE BILLING PERIOD WHEN THE DISCONNECTION OR DOWNGRADE OCCURRED SHALL BE ENTITLED TO, ON A PRO RATA BASIS, A REFUND, OR IN THE EVENT OF A DOWNGRADE, A BILLING CREDIT. § 2.
